Judge blocks probe into Carcieri campaign
March 27, 2006

PROVIDENCE, R.I. --A state judge has halted a Board of Elections' investigation into a 2002 TV ad supporting Gov. Donald Carcieri's first campaign for governor.

Superior Court Judge Stephen Fortunato ruled Monday that the board's procedural rules were unconstitutional and he issued a permanent injunction halting the investigation.

The ruling could leave the Board of Elections in legal limbo, unable to investigate new campaign finance complaints until it adopts new rules, said William Lynch, chairman of the state Democratic Party.

"This also effectively, completely obviates campaign finance law in Rhode Island. There's no one to enforce it," Lynch said.
