3. Nobody should ever be able to seize anyone's medical records.
But it seems to be a trend these days.

I always thought it was illegal to do so.

That's a pretty broad brush. Is it ok for the defense to offer someone's medical records as evidence if it supports a client's innocence? I wouldn't want to see it as routine, but there are cases where medical records are relevant and the defense and prosecution should have access to them.

if people could see them them easily patients wouldn't be honest with the doctors. That is not a good thing.

4. If there's evidence that he was using multiple doctors to acquire a class
3 narcotic, I would think that would be a good reason to grab the records.

6. Part of the new HIPPA Regulations, I assume....Or, proves enough evidence
that he was involved in a Criminal Drug Ring that they want to check out
how many prescriptions he was given, and maybe a couple of his 4 doctors were suspected of writing illegal prescriptions. If they they were suspected then their records of their patients could be taken to see if their were any drug dealers getting prescriptions from these doctors.

Sounds like there's a big case there. Limbaugh may be a tiny piece or the whole magilla, who knows.

15. Maybe he isn't involved in the drug ring but a couple of the doctors are?
However, he was buying an awful lot of pills not to be doing something illegal no matter what his attorney says.

if the ACLU were to come to his defense on the medical records issue. There's no excuse for seizing some addict's medical records just to find if he's popping more than his share of Oxy. I don't care where he's getting it, it's nobody's business, and CERTAINLY not the government's.

Of course, it couldn't happen to a nicer guy, but the slope is just as slippery whether it's Rush or Jane Doe in Poughkeepsie.

... prescriptions would be my guess. Having four separate doctors prescribing the same stuff within the same time period would look suspicious.

It is highly unlikely that Limbaugh was "filling" his prescriptions in a convenience store parking lot. Limbaugh will try to defend himself as a victim of addictive prescriptions when in fact there are no prescriptions. If there were he would have just got the medication legally.

I think we are going to see a full fledged investigation of Limbaugh. This is preparatory to that. His lawyers will do what all lawyers do: lie their asses off and I am sure the DA in this case does not want a OJ farce.

Limbaugh supported the most vicious use of investigation is the cases of Clinton and Condit. What goes around comes around.

what his lawyer is saying is "My client is a well-connected favourite son of the GOP. the same laws that apply to you smelly lower classes don't apply to Him (bless his name). Now go away. He said he was sorry, He went to rehab (and sat in his shit-ed.) and now You People want to hold Him to the same standard He wanted to hold you in His 1995 statement about taking all drug users and throwing them in prison. You just don't get it, do you? Rush is NOT like you..."

8. the problem isn't that rush had prescriptions for legitimate drug use.
the problem is that he illegally obtained drugs WITHOUT a prescription.

his lawyer conveniently leaves that fact out of the article. in addition, rush bought those drugs with cash that he laundered for illegal purposes by withdrawing amounts very close to, but not exceeding, the amount which requires federal reporting.

despite his claims to the contrary, i was informed by my bank the VERY FIRST TIME i tried to avoid filling out the forms that withdrawing an amount CLOSE TO the limit for the purposes of avoiding reporting is ILLEGAL. so i filled out the forms. and no, i wasn't using the money to BUY DRUGS ILLEGALLY LIKE RUSH LIMBAUGH. 8^) so i wasn't afraid to fill out the forms.

9. His lawyer's response sounds like there's bad news coming for Rush
The fact Rush's lawyer is attacking the State Attorney's Office at this point is not a good sign for him. His attorney must believe that the prosecutors are seriously trying to make out a case against him. Otherwise, I can't see why a lawyer would attack the prosecutors in this fashion before they make the decision whether to charge him. That's sort of like an Olympic diver bad-mouthing the judges before they score his/her dive. Not such a good idea.

Aw, poor Rush. If he can't get a fair shake in Florida, where could he possibly go for some republican-style justice? I'm just glad that the violations aren't being investigated in San Francisco county, or we'd never hear the end of the "vast left-wing conspiracy" whine.
