AP: Former Boston man charged in Texas with aiding terrorists
Former Boston man charged in Texas with aiding terrorists

By Joe Stinebaker, Associated Press Writer | February 13, 2007

HOUSTON --A man arrested in Kenya last month was ordered held without bond Tuesday
on charges that he joined with al-Qaeda to help overthrow the Somali government and
form an Islamic state there.

Federal officials charged Daniel Joseph Maldonado, 28, a Muslim convert also known as
Daniel Aljughaifi and Abu Mohammed, with undergoing military training with a terrorist
organization and conspiring to use a destructive device.

Maldonado, a native of Boston who also lived in Houston, was returned to the United
States on Monday night and appeared before U.S. Magistrate Judge Calvin Botley Tuesday
afternoon, the U.S. Attorney's office in Houston said. He was ordered held without bond
until a detention hearing next week. Nancy Herrera, a spokeswoman for the U.S. attorney's
office, said she was unsure whether Maldonado had an attorney yet.

Maldonado's arrest marks the first criminal prosecution of an American suspected of joining
terrorists in Somalia, Assistant Attorney General Kenneth Wainstein said in a statement.

1. So this guy commited his "crimes" entirely in Africa...
...and was apparently targeting the Somali government, yet this somehow gives the US Government jurisdiction? What did I miss?

4. OK, but presumably the countries in which the crimes...
...were actually committed would have a greater claim? I don't see why Kenya just handed him over. Or why the Somalis don't want him.

10. I'm sure that the right palms were greased.
Consider how AWFUL the DOJ's record is on prosecuting "terrorists" -

They're 0 for everything. Complete losers!

So Gonzales must be thinking, hoping, that ruining this poor sap will bring some redemption (doesn't hurt that he's brown-skinned, since that fact reinforces certain stereotypes that the admin. seems to be interested in perpetuating).

5. that doesn't make sense to me
If an American indulges in marijuana and hallucinogens while in Amsterdam, they can be charged in the US?

9. If an american goes on a killing spree, or buys children overseas etc.
then they can be prosecuted here.

I don't think anyone's going after soft drug users in Amsterdam. What a ridiculous thing to criminalize anyway.

12. No he is no longer a citizen, he is now an "enemy combatant"
With that nomenclature and that alone he loses all his citizenship rights. On just the sayso of one or two people he no longer has a right to even attempt to proove himself innocent. No Habeas Corpus rights, no rights of any sort because someone somewhere "said" he was an "enemy combatant" Sure makes it simple. No trial costs or anything...

13. Yet the Bushistas can aid al-Qaeda by providing them with secret info about US intel operations...
...and no one even suggests they should be charged with a crime?
