UN top court says Srebrenica massacre genocide

THE HAGUE, Feb 26 (Reuters) - The highest U.N. court said on Monday that the massacre of Bosnian Muslim men in Srebrenica in 1995 fulfilled the conditions required to constitute genocide.

Bosnia has asked the International Court of Justice to rule on whether Serbia committed genocide during the 1992-95 war. It is the first time a state has been tried for genocide, outlawed in a U.N. convention in 1948 after the Nazi Holocaust.

Reading from a lengthy judgment statement in advance of pronouncing the final ruling, ICJ President Judge Rosalyn Higgins said: "The court concludes that the acts committed at Srebrenica fall in articles ... of the (genocide) convention."

THE HAGUE, Feb 26 (Reuters) - The highest U.N. court said on Monday that although the massacre of Bosnian Muslim men in Srebrenica in 1995 constituted genocide, Serbia was not responsible for the mass killing.

"The court finds that the acts of genocide at Srebrenica cannot be attributed to the respondent's (Serbia) state organs," said International Court of Justice President Rosalyn Higgins.

She said it could also not be established that Serbia had been complicit in the genocide at Srebrenica by supplying aid to the Bosnian Serbs at a time when it knew those forces had the intent to commit genocide.

Yes, there were horrible problems in the region, and we should have given them our attention, but that wasn't the reason for the military actions. All of Yugoslavia and Albania as well, were invaded by NATO forces to destroy their socialist closed market systems and opent hem up to Western capital.

THE HAGUE, Netherlands - The United Nations' highest court on Monday exonerated
Serbia of direct responsibility for genocide in Bosnia in the early 1990s, but ruled
that it failed to prevent the slaughter of Bosnian Muslims at Srebrenica. The
International Court of Justice said Serbia also failed to comply with its obligations
to punish those who carried out the genocide after the Bosnian Serb army captured
the U.N. enclave in July 1995, and ordered Serbia to hand over suspects for trial
by a separate U.N. court.

The Serbian leaders "should have made the best effort within their power to try
and prevent the tragic events then taking shape," in the U.N. enclave, the scale
of which "might have been surmised," the ruling said.

However, it rejected Bosnia's claim for monetary reparations.

Outside the Peace Palace, which houses the court, dozens of Bosnian Muslim
demonstrators chanted, "Thieves. Corrupt judges."
