Constitutional Lawyers . . . Where Are You? (North American Union/SPP)
Daneen G. Peterson, Ph.D.
January 31, 2007

Of course all lawyers are very busy, but there's a significant issue that needs your attention which could be of substantive legal import regarding the creation of a Mexican customs office which is planned for the KC SmartPort. It will stand on American soil as part of the federal government's Security and Prosperity Partnership (SPP), a stealthful mega-project being developed under the aegis of the Department of Commerce. Supposedly, the Kansas City SmartPort agreement will allow Mexico to claim 'sovereign territory' on American soil and arrogantly fly their Mexican national flag over it.

It is posited here that a learned Constitutional lawyer might be able to stop ALL the Security and Prosperity Partnership (SPP) projects in their tracks since they ALL involve the signing of agreements with 'Foreign Powers' ALL of which are being done without Congressional approval, in violation of our Constitution, as detailed below in Part I.

In addition to the KC SmartPort . . . there are other signed agreements with foreign governments for the CANAMEX corridor, and the Trans-Texas-Corridor (TTC-35) also discussed below. There exists many more signatories since there are some 80 super-corridor projects planned and in motion across the country. All these projects are aimed at creating the North American Union without ANY congressional oversight in violation of our Constitution.

It would be a coup de grace for 'We the People' if the One World Monopolists were stopped in their tracks using the very instrument they seek to shred, crush and destroy . . . our Constitution --

The Constitution may be the only way to stop this.

3. This is deadly serious--
The multinational cooperations who've been dumping millions of lobbying dollars in D.C. are behind this operation; and they find our the Constitution and our borders to be "inconvenient." This crowd is no group of patriots.

5. Bush signed an agreement with Canada and Mexico
to eliminate borders starting in 2008 I believe. I have watched this for a very long time. The Globalists admit that the reason they are doing this is to drive down wages. Think about it. They already have the European Union and the African Union. The North American Free Trade Agreement(NAFTA) was put in place under Clinton. This has been planned for a very long time.

7. Big Business Buys Silence of Toll Road Critical Newspapers--
The NAFTA superhighway/Trans Texas Corridor--

A foreign toll road corporation has agreed to buy dozens of newspapers in Texas and Oklahoma that have up until now been harsh critics of the Trans Texas Corridor superhighway, a clear example of influence peddling that pointed to racketeering, and a desperate lunge to silence dissent against the sellout of American infrastructure and the North American Union.

"Australian toll road giant Macquarie agreed Wednesday to purchase forty local newspapers, primarily in Texas and Oklahoma, for $80 million. Macquarie Bank is Australia's largest capital raising firm and has invested billions in purchasing roads in the US, Canada and UK. Most recently the company joined with Cintra Concesiones of Spain in a controversial 75-year lease of the 157-mile Indiana Toll Road," reports The Newspaper.com.--

8. Here's a constitutional opinion
This is right-wing hysteria fueled by a number of xenophobic conspiracy theorists, who will ironically find allies on the left. This particular hysteria comes to us courtesy of Jerome Corsi, most famous for swift-boating John Kerry.

12. It exists
The UN exists - that doesn't mean they're bringing "One World Government!" w/black helicopters, like the right-wing wackos say.

The SPP was formed to work together on border issues & terrorism - not to create ANY kind of common government. You just posted the SPP's "myths vs. facts" page, inspired by these conspiracy theories. Try reading it - it addresses everything in the OP.

14. The UN & the EU are powered by the same forces behind NAFTA, CAFTA & the upcoming N. American Union

All the same wealthy international families are behind this movement -- generation after generation. They have far more financial resources that the entire U.S. budget.

Awakening is a good thing.

I mean, unless with "The UN & the EU are powered by the same forces behind NAFTA, CAFTA & the upcoming N. American Union" you're referring to far more elusive, impersonal and always fluid market economies, I seriously suggest to put away whatever may interfere with your consciousness.

Anecdotally, I've lived not too far from Hotel Bilderberg.

But the current heterogeneous motivations to vote down the ill-named "EU Constitution" in France and the Netherlands (for different reasons in each of those countries - none really touching the core of the idea for an EU itself) are both living and livid proof that there's no such thing as a forced top-down imposition of "the EU". If only because the EU has a very horizontal and peer-driven structure. That same, voluntary cooperative transnational disposition is what keeps the fragile UN barely together; it's also what explains why the UN is no match to intervene and avoid idiotic rampaging enterprises like the war in Iraq. Like most any club of volunteers, they're extremely sensitive and powerless in the face of unabashed vandals, like GWB.

Maybe NAFTA is different - in fact, I admit that it certainly has the look and feel of being much more arranged in chambers among a select group of privileged elites. Then again, NAFTA is a club of three. The mere idea of comparing a club of three with a current 25-member EU or, worse yet, the 192 current member nations of the UN... Preposterous, really.

Seriously, the phantoms of conspiracy may suggest themselves as a tantalizing mantra, but the entire rest of the world doesn't necessarily play by Stephen King scripts - if at all they "get" his sense of humor.

Illuminati, Skull and Bones, Bilderberg, why not throw in the Masons, Protocols of the Elders of Zion, and a few Arab Oil Sheikhs to accompany the NAFTA, EU and UN, mix and enjoy the smoky views!

Pardon my snickering, but I think the whole One World Government notion is actually borne from some creative minds at the marketing department of Alcoa.

Get some sleep, Demok. One needs to be well-rested to be awake and alert.

19. The corporate forces represented by the Bush Administration put ..
.. a great deal of energy into weakening the UN -- and spent much of the early part of this century trying to foment discontent in Europe with the EU. But the same forces have lobbied relentlessly for NAFTA-like treaties. There is actually a coherent (and, I think, rather unpleasant) explanation for such politics -- but you won't find such a coherent explanation without attempting a considerably more sophisticated analysis than you are currently providing.

13. To begin with, the cited clause prohibits the individual *states* from signing agreements

with foreign powers without the approval of Congress.

The prohibition is limited to states.

Edit: "State" in the clause refers to one of the 50 states, not to the nation-state. If the program is federal, there is no violation under the cited clause.

16. Regarding "Treason Abounds"
If anyone who reads my article titled "Constitutional Lawyers . . . Where Are You" and doesn't find substance, truth or proof there . . . then I would advise you to educate yourself by reading my "Treason Abounds ~ Gov't Cabal Plots North American Union (NAU)" found here: http://www.StopTheNorthAmericanUnion.com

'Treason Abounds' is the most comprehensive article you will find covering the Shadow Government's plan to create the North American Union and end America as we once knew it. It is a treasure trove of information with 92 photos and graphics and 120 clickable references that will take the reader to the source material, much of which comes from GOVERNMENT websites.

18. Lumping "UNESCO, LOST, Earth Charter, Agenda 21, Areas Foundations, CANAMEX, 'Global Warming' and ..
.. the Kyoto Treaty, the World Court, The Hague, WTO, GATT, NASCO, NAFTA, CAFTA" together -- as if these various organizations and treaties represented one single view -- seems to me inexcusably sloppy analysis.

And the problem with sloppy analysis is that it does not help anyone think clearly about what is actually happening, why it is happening, what it suggests about the future, and how to fight back.

I must admit that I am entirely unsurprised to find warnings about the supposed "North American Union" most loudly repeated by the folks at Human Events, Eagle Forum, World Net Daily, Renew America, Vive le Canada, News Max, and other such sites.

You seem to believe that the Administration is moving to loosen controls on population movements and open borders. In fact, the Administration appears to be moving the opposite direction:

U.S. Will Tighten Passport Rules
Canada, Mexico Borders to Be Affected by 2008
By John Mintz
Washington Post Staff Writer
Wednesday, April 6, 2005; Page A01

Millions of Americans will be required to show passports when they reenter the United States from Canada, Mexico and the Caribbean by 2008 under new rules announced yesterday by the State and Homeland Security departments ...

http://www.washingtonpost.com/wp-dyn/articles/A28188-2005Apr5.html

Any cogent analysis should be able to explain such "quirky" little details.

21. Talk about sloppy analysis

I must admit that I am entirely unsurprised to find warnings about the supposed "North American Union" most loudly repeated by the folks at Human Events, Eagle Forum, World Net Daily, Renew America, Vive le Canada, News Max, and other such sites.

How 'bout some "guilt by association" logical fallacy of your own? http://en.wikipedia.org/wiki/Association_fallacy

It's true that those on this side of the debate rarely agree with those on that side of the debate, but there are more and more times lately when there's a common concern. Bob Barr teamed up with the ACLU. Arlen Specter is taking up against Bush with Sen. Leahy. Etc. It DOES happen.

There have been other reports about a North American Union. It sounds preposterous, until you remember that nearly every damn thing that's happened since Jan 20, 2001 has been equally preposterous. Would YOU ever have thought we'd attack and utterly destroy an innocent country? Or that habeus corpus would be tossed out like so much old garbage? Or that Bush would put himself simply ABOVE the law and defy ANYone to do anything about it? (And get away with it -- so far.)

I don't know if I believe it, but I damn sure ain't dismissing it out of hand, and CERTAINLY not for the reason you suggest.

Further:

You seem to believe that the Administration is moving to loosen controls on population movements and open borders. In fact, the Administration appears to be moving the opposite direction:

Did it ever occur to you it's entirey possible to do both, simultaneously? What do YOU think this "guest worker" program of Bush's is all about anyway? You think he's just being nice, because he's sincerely interested in improving the lot of so many poverty-strickent Mexicans?

22. Since you ask, I think the objectives of the "guest worker" program are well-described in ..
.. the following article:

Transient Servitude: The U.S. Guest Worker Program for Exploiting Mexican and Central American Workers (Richard D. Vogel)
http://www.democraticunderground.com/discuss/duboard.php?az=show_mesg&forum=367&topic_id=549&mesg_id=549

That is cogent analysis: it is based on examining the specific effects of specific policies, and it has the advantage of suggesting how to obtain a better understanding of what has been happening, who will benefit, and who will get screwed.

Perhaps you should compare that article to the website suggested in the post on which I was commenting when I apparently irritated you. My response began with a portion of text (lifted directly from the suggested website), which is entirely representative of said website. That website is occupied by rather typical rightwing claptrap and contains nothing at all resembling an intelligent view of the oligarchy's current economic policies and plan: instead, it worries that borders will be opened to surging hoards of Mexican-flag-wavers. The exhibited inability -- to distinguish institutions such as UNESCO and the Hague from the free trade treaties sought by modern capitalists -- shows that the "analysis" there is unscientific and can only mystify events; more evidence (if any were needed) is provided by the lumping of the idea of global climate change with the free trade treaties. If one observes -- that this emotional juxtaposition of useless ideas occurs with tedious predictability on a number of rightwing websites -- then one knows the political pedigree of the ideas: I can only regret it, of course, if (in your world) such observation counts as a logical fallacy.

People interested in a coherent view should stay far away from carefully crafted rightwing claptrap and should attempt to produce a useful analysis. In my view, the Vogel article is a good example of such an attempt.
