NEW PORT RICHEY, FLORIDA- Supporters of people in pain and privacy advocates join together this Friday, April 9th at 7:00pm for a candlelight vigil calling for the release of Richard Paey and an end to law enforcement’s focus on medical practice. Two bills in the Florida Legislature, House Bill 397 and Senate Bill 580, would allow more government intrusion into medical privacy, further chilling legitimate pain management and allowing prosecutors to attack yet more people in pain like Richard Paey.

“Richard Paey was prosecuted three times in the very same district that is represented by Senator Mike Fasano, the sponsor of Florida’s Prescription Monitoring Bill. Sen. Fasano’s claim that prosecutors won’t use private medical information gathered in government computers against patients in pain, is exposed for the hollow assurance it is,” Pain Relief Network’s Founding Executive Director Siobhan Reynolds said.
“Law Enforcement already looms over medicine to such an extent that patients with the highest dose requirements, those with the most severe pain, can’t find medical help. Prescription Drug Monitoring Programs only ensure that the undertreatment of pain will continue to plague our most vulnerable citizens and their families.”
Richard V. Paey sits in jail, in his wheelchair, with advanced Multiple Sclerosis and a morphine pump sewn into his ruined back, awaiting the outcome of his court hearing on April 16, 2004. The judge will hear Paey’s motion to acquit based on the perjured testimony of the physician, Dr. Stephen Nurkeiwicz, who had been trying to treat Paey’s pain, himself under threat of criminal prosecution. The judge will also hear the Paey family’s pleas for mercy, as Paey faces a mandatory minimum of 25 years in Florida prisons.
If Paey’s attorney Robert W Attridge Jr. wins, Paey will return home to his wife Linda, an optometrist and their three children. If he loses, Paey will live out-what for him is a death sentence-in a Florida prison for possessing the medicine that he requires to survive.
