WHat happens if Al Franken Looses?
What happens? Will they recall all the books? Will AL have to pay a fine or will his publisher?

As wrong as it sounds,I think its possible Al could loose.Fox is sneeky & they will find a loophole or something. They just sound way to confident to me.I hope the Judge isn't a Judge Moore type/freeper!

If yes, how did you get it? I can't find any release date other than September 22. Bummer.

10. Just ordered one from Amazon...!
They have a double-whammy--Franken's book and Conason's book for $35. Free shipping. Sign me up!

I figure I need a little time to finish Will Pitt's book before diving into Franken's.

Rock on!

3. Ain't gonna happen
Its a Faux intimidation tactic. Let your critics know that you will bury them with attorney fee expenses if they criticize you....

There is no way Faux will prevail. They are bullies. I hope it goes to trial (although it will probably get tossed out on a summary motion) so we can see all these idiots at Faux testify.

I'd pay money for tickets to see that

4. Hmmm
I imagine subsequent issues of the books will have a different title and the publisher will pay a fee. However, they'll probably more than make up for the fee in increased sales of the books. And *my* copy with the original title will increase in value.

8. Very unlikely
I'm not a lawyer, but I don't see any way they could win this case.

When it's over and Al wins, he should send them a gift basket as thanks.

9. If Franken loses
Edited on Thu Aug-21-03 11:48 AM by Hamlette
and it won't happen, the publisher pays, not Franken. There could be a clause in the contract that it comes out of Franken's share of the profit. They will recall the books which have not yet been sold. They will NOT come to your house and try to confiscate your copy. (Oh, wait, Ashcroft is in power, maybe they will. Kidding.)

I picked up the book last night and started reading it. Most of the stuff so far is stuff you already know from reading it on the web (the lies in Coulter's book) but its great to see it will get a larger audience AND it is hysterically funny. (refraining myself from telling you the opening line which is laugh out loud funny.)

11. "looses" what?
Just kidding. My internal grammer Nazi is on hold these days, but when I see things incorrect in titles I get all Himmler. :)

I couldn't help myself - my mom was an English teacher.
All in good fun - no offense intended.

12. Why does a foreign owned business get away with targetting
an American citizen's right to free speech? I don't give a rat's ass if Rupert Murdoch thinks he owns the English language, he really only owns one word in my lexicon: "unAmerican."

The insults and name calling in FOXes legal brief expose them for the whining crybabies they are. He wins either way

16. Can you picture O' Reilly?
O' Reilly: "Goddamnit, Rupert, you either sue that bastard or I'm gonna quit!"

Rupert: "Okay, okay. Calm down, Bill, I'll see what I can do. I'm sure there's someone our legal department can sue, but I'm not sure how much good it will do."

O' Reilly (sniveling and whiny): "That's all I ask." Sniff, sniff.

19. ....
The best aspect of his case is that Fox intentionally waited until many of the books had been printed.

The debate between Franken & O'Reilly was back in May or June. WHy NOW are they having such a hissy fit? Why not right after the C-SPan debate?

23. "Fair and Balanced" Candidate
"Fair and Balanced" Leadership
Fox News is suing Al Franken for using the phrase
"fair and balanced" in his book. Fox has trademarked
this extremely common phrase. In support of Al,
Charlie takes a Fair and Balanced look at the world.
