Because this du'er fails to see how we won. Oh great we get to keep the fillibuster in 'extreme circumstances'? According to who? To my mind a power mad political party that got all of their nominations but 7 and want to destroy senate tradition because of it is an extreme circumstance.

You actually trust these idiots on the other side of the aisle to keep their word and not throw another hissy fit when a supreme court nominee comes down the pike? You honestly believe that this is going to be framed in the media as anything other than a republican victory? Yes, Frist will be cast as a pariah and loser in this but they will frame it as the moderate wing of the republican party getting credit and use it to pontificate about how the moderate wing of the republican party REALLY calls the shots.

The Senate becomes a windy rubber stamping agency now? Democrats won't cause a fuss unless it's something really bad? Like what? How bad does legislation or judge have to be now? What keeps the repugs from just doing this again when Bush nominates some wingnut fruitcake to the SCOTUS? We filibuster, because we "won" this great battle...The Republicans in the Senate will refrain from changing the rules then? Meanwhile Bush gets 7 more right wing activist judges. We don't gain jack here. We look weak.

Who determines what "extreme circumstances" are? I'm pretty far from being a member of the alarmist/extremist faction of the democratic party but this looks, smells, and acts like a raw deal to me. I've yet to read someone explaining it to me otherwise. Big deal, Frist looks bad.He was never anything other than an extremist anyway and never had a shot at anything close to the presidency. So what did we gain?

20. Without compromise, Scalia or Thomas would be Chief Justice
Without this compromise, I am sure that Bush would put up Thomas or Scalia as chief justice when Rehnquist retires. We have preserve the right to filibuster on a supreme court nomination in just this type of circumstance. Bush is not free now to put an extreme right winger onto the Supreme Court.
