LOS ANGELES -- A Los Angeles judge has rejected a request to halt the DVD release of the hit spoof movie "Borat" by two fraternity brothers who say they were duped into misbehaving on camera.
West Los Angeles Superior Court Judge Joseph Biderman -- who heard arguments and took the request for a preliminary injunction under submission last Thursday -- submitted a decision on Friday.
Biderman said that the pair had failed to show reasonable probability of success on the merits or that money damages alone would be inadequate to resolve their complaint.
The South Carolina fraternity brothers sued Nov. 9,
claiming they were tricked into making racist and sexist remarks to British comedian Sacha Baron Cohen in "Borat: Cultural Learnings of America for Make Benefit Glorious Nation of Kazakhstan."
The men claimed that the filmmakers got them drunk at a bar before getting them to sign release forms agreeing to appear in the film -- and were told the documentary would be shown outside the United States.
An attorney for 20th Century Fox said he was pleased about Friday's decision.
