Leading Republicans say that because of their increased Senate majority, they now can overcome an amendment by Sen. Charles Schumer (D-N.Y.) that prohibits those convicted of abortion-clinic violence from filing for bankruptcy protection to avoid paying court fees. Republican leaders plan to call up the legislation on the first week back from the Presidents Day recess.
If Republicans succeed in passing bankruptcy legislation, it would be their second major victory on pro-business legislation this year, on the heels of legislation the Senate approved last week to curb class-action lawsuits.
Schumer was first able to attach his amendment to bankruptcy legislation at a Judiciary Committee meeting in 2000, and the issue has been the major sticking point in enacting a bankruptcy bill since then.
