Time Reporter Called a Key to Rove's Defense In Leak Probe

The reporter for Time magazine who recently agreed to testify in the CIA leak case is central to White House senior adviser Karl Rove's effort to fend off an indictment in the two-year-old investigation, according to two people familiar with the situation.

Viveca Novak, who has written intermittently about the leak case for Time, has been asked to provide sworn testimony to Special Counsel Patrick J. Fitzgerald in the next few weeks after Rove attorney Robert Luskin told Fitzgerald about a conversation he had with her, the two sources said.

It could not be learned what Luskin and Novak, who are friends, discussed that could help prove Rove did nothing illegal in the leaking of CIA operative Valerie Plame's identity to reporters and the subsequent investigation of it.

Rove's fate remains uncertain. He has testified that he talked to columnist Robert D. Novak and Time magazine's Matthew Cooper about Plame's CIA employment. But in his initial conversations with federal investigators and testimony, Rove did not mention the conversation with Cooper, later telling the grand jury he forgot about it and did not intend to mislead anyone, according to lawyers in the case. Luskin has worked behind the scenes to convince Fitzgerald that Rove is guilty of nothing more than a faulty memory.

1. Okkkayy, KKKarl....
One reporter, you may have a faulty memory of but not two, perhaps three? If I had told a secret to more than one person, I sure as hell know that I've started a rumor to be passed on to more.

2. I can't find the
thread, but earlier today someone posted a link to an article indicating that Fitzg is talking to Kkkarl's assistant regarding why a call from one of the reporters was not logged and the response seems to have been covered in fudge--oh, it must have come in thru the WH switchboard, rather than thru me--but they checked and found out that the WH switchboard calls are also logged.
That type of detail seems to indicate that there MAY be a lack of candor that I do not think the reporters could alter thru selective or perfect memory on their part.
I'm thinking the reporters angle is Kkkarl-spinnery.

4. god, the premise for this "memory lapse" is so f>cking ridiculous.
when the entire nation is on the edge of their seats you don't forget anything... you think about every detail every moment of your life... you replay tapes in your mind of the presentation you'll make in court... you re-think every frigging detail in the hopes you can outsmart the prosecutor... kkkarl thinks like a criminal because he has a criminal mind, so he's also got a perfect memory, however verbally selective. and Fitz knows that...

9. Rove should get a new lawyer
Any lawyer who has a client in Rove's situation and does not physically tie him to a chair to prevent him from testifying before a grand jury should have his law school diploma run through a shredder.

Rove would likely not be in this mess and facing indictment and resignation if he had taken the Fifth. Sure it would look bad, but that never stops KKKarl. He could have just said he was refusing to go along with a rogue prosecutor or some such BS.

On second thought, maybe Luskin should represent everyone at the White House.

I thought one had either waived the right to take the Fifth or could not do so in front of a grand jury. Is this true?

Somehow, I'm thinking Rove's failure to take the Fifth is the least of his problems. If he is, or has ever been, the sand-flinger, it should be a very interesting few months for him.
