can someone explain "evolving standards.."
guided by the 'evolving standards of decency that mark the progress of a maturing society

This is not an Alito post. A wingnut has brought this up. What is our scholarly basis for this thought?

1. It comes from, IIRC,
various Supreme Court decisions regarding the death penalty and the 8th Amendment prohibitions against cruel and unusual punishment.

In other words, being locked up in stocks in the public square used to be a punishment for minor crimes back in the day. But these days we recognize it for the humiliation it is.

Same with death by hanging, permanent solitary confinement, etc.
