When A Democrat Wins The WH In '08...
whomever it may be...

We should deluge John Paul Stevens, David Souter and Ruth Bader Ginsburg with letters asking them for the sake of the country to please step down sometime before 2011, ensuring that 4 votes (Breyer is still relatively young) remain in the hands of sane justices.

And that Democratic President must look for 3 YOUNG (under 50) legal superstars who can sail through the nomination process.

Republicans have been outplaying us at this game since Nixon. We have to learn how to stack the court just like they've been doing for fourty years.

1. Or we could do as another poster suggested...
And increase the number of justices to eleven...

All the while making sure they are liberal...

Might be a more productive path...

2. Didn't Roosevelt try that?
I don't remember it working out so well.

4. won't work
Roosevelt tried and it was his biggest defeat. We shouldn't muck with the constitution. We should get the oldest justices who are on our team to resign while a Democrat is in power.

6. Congress sets the # of Justices on the Court, not the Constitution.

8. True, but he wanted to add six. Doesn't the constitution give the
president discretion to add two?

Nigel Tufnel in '08!

7. Good points. I would add
that we also impeach Scalia and Thomas as being part of the cabal that put * in power. That appointment was illegal.

9. Don't worry, we are not winning unless Gore enters the race.
