President (Clinton) Is Denied Executive Privilege

federal judge has ruled that President Clinton cannot use the power of his office to block prosecutors from questioning his senior aides, rejecting Clinton's assertion of executive privilege in the Monica S. Lewinsky investigation, lawyers familiar with the decision said yesterday.

the Clinton case was regarding a civil lawsuit.

It most likely wouldn't be applied to a congressional subpoena.

In a ruling issued under court seal Monday, Chief U.S. District Judge Norma Holloway Johnson concluded that independent counsel Kenneth W. Starr's need to collect evidence in his obstruction of justice probe outweighs Clinton's interest in preserving the confidentiality of White House discussions, the lawyers said.

Therefore, if Congress suspect that Alberto did mislead them, and the subpoena of Miers is being used to collect evidence, then surely Exectutive Privelege does not apply....

I am wondering why sites like Huff Po haven`t picked up on this...It does rather shoot Bush`s argument down in flames methinks..

I was just reading little lord pissypants comments, and then visited wrh, and I`m like, hang on a second, this is established law...

just thought I would bring it to everyone`s attention, so next time some neanderthal reslug starts with "but but Clinton..." you can finish the sentence with "was denied executive priv....etc etc"

I do actually think this is quite important...
