1. Since Viacom is owned by the same good folks who own McBush and the republicans...
they probably don't even care.

This is not readily available footage. Someone had to get a copy of the film and snag a clip from it. Viacom brought suit against YouTube for allowing users to post stolen clips from their films. I really don't think fair use covers airing snippets of commercial films from major studios.

Think of all the film snippets on THE DAILY SHOW.

Since political speech has always (and improperly, BTW) been afforded the greatest latitude of any form of expression no court would humor an actual Viacom legal action. That doesn't mean Viacom cannot make a strong request it be withdrawn. Just that such a request would have no legal teeth.

On Edit: I shouldn't have said it's the quintessence of fair use. I should have said it is typical fair use. The quintessence of fair use is including a paragraph from a book in a review of the book.

I bet you ten to one that when and if The Daily Show uses clips from commercial films, they have to pay the studio that owns them.

8. I don't know. But, they have a history.
They used a song without permission in the "Media Love" ad, and had to take it down. THey used Paris and Brittany's images without permission and are now catching heat.

I doubt they even bothered to care one way or the other.
