The lawsuit that Steven Marquis of Fall City, Washington filed,
was dismissed on 27 October.
This was a suit simular to Berg's suit that demanded that the Washington Secretary of State confirm Sen. Obama's citizenship.
"A King County judge has thrown out a lawsuit challenging Barack Obama's qualifications to be president.
The secretary of state's office says Superior Court Judge John Erlick dismissed the lawsuit on Monday.
It claimed Obama's U.S. citizenship was in question, saying that could make him ineligible for the presidency. The plaintiff, Steven Marquis of Fall City, claimed Obama may have been a citizen of his father's native Kenya, or became a citizen of Indonesia when he lived there as a boy.
Obama was born in Hawaii to an American mother and a Kenyan father. After his parents divorced, Obama's mother married an Indonesian man.
A similar lawsuit was thrown out of U.S. District Court in Philadelphia on Friday."
The
Tri-City Herald had a longer article on the subject,
complete with PDF of the Judge's order.
"Washington's Secretary of State Sam Reed does not have the authority to inquire into Obama's birth certificate and determine if it is valid or not, said Superior Court Judge John Erlick. Therefore, Reed is obliged to accept the nomination and keep Obama's name on the state ballot, Erlick said.
Doing any external fact-finding "is not authorized by the state constitution or state law or administrative rule," he said.
Erlick dismissed the lawsuit, noting that plaintiff Steven Marquis failed to name Obama as a party to the lawsuit.
"The 2008 general election is already in progress; ballots have been issued and a substantial number of voters have voted," said the order signed by Erlick."
So that's at least one down, statewise. Several others are still pending. not to mention Berg's appeal to the US Supreme Court and anti-semite Andy Martin's Hawaii case on 18 November. Since many of the state cases are cut and paste from the Berg case, it's likely we'll be seeing more bounces.
