Court Rules Kan. Can't Single Out Gay Sex
TOPEKA, Kan. -- The Kansas Supreme Court on Friday unanimously struck down a state law that punished underage sex more severely if it involved homosexual acts, saying "moral disapproval" of such conduct is not enough to justify the different treatment.

In a case closely watched by national groups on all sides of the gay rights debate, the high court said the law "suggests animus toward teenagers who engage in homosexual sex."

Gay rights groups praised the ruling, while conservatives bitterly complained that the court intruded on the Legislature's authority to make the laws.

Boy this story has really got them frothing at the mouth in freeperville. It's the fall of the Roman empire all over again LOL.

"Moral disapproval of a group cannot be a legitimate state interest."

But finally a court has stated that dictating "moral values" is not a function of the government.

2. I just have to go and read some of the freeper responses
to this kind of stuff, but it sure is scary that I live in a country inhabited by people that are so out of touch with reality.

3. or obsessed with others sexual preference
Glad the courts realize the government doesn't belong in the punishment of gay acts.

5. You said it much better than I did
The government does not belong in the sex lives of its tax paying adult citizens.

8. This case doesn't deal with that
It's talking about the crime of underage sex, i.e. statutory rape. In this case, at least one of the participants is legally incapable of consenting.

9. While it does talk about statutory rape
the principle focus concerns the disparity of sentencing between the two groups, i.e. heterosexual v. homosexuality, as the age of consent in this state is 19 so neither party has capacity to consent.

6. Decisions like this reaffirm my faith that there are.........
...still good, solid judges who make good, solid decisions, even in the "red" states where bigoted conservatives run rampant as they try to corrupt the courts.

7. most Freepers adore gay sex
and practice it often. But they are too hypocritical, moronic, evil and brainwashed to realize that that's the way their "God" created them.
