More likely than not, of course Alito in fact is not a Springsteen fan at all. That bit of trivia is almost certainly pure fiction, with the obvious purpose of making Alito appear like a regular schmoe like us.

They knew the media was going to simply report it unchallenged. How can you question something so trivial like musical taste?

Similarly, the dems can't possibly challenge Alito on something so petty, right? How could they prove Alito isn't a Springsteen fan? When Durbin brought that up, was he going to quiz Alito on band lineups or something like that?

No, that would be impossible.

But what Durbin can do and did to is to recognize that Alito's PR people were trying to borrow the Springsteen myth in the same exact phony way that Alito's old boss Reagan did a generation ago.

So that's what Durbin goes after, the myth. Durbin did some research and found a quote that showed the real Springsteen, and used that quote repeatedly against the reality of Alito's record. And showed Alito to be a phony.

The quote was Springsteen saying "I am familiar with the crushing hand of fate" and he was answering a question about the song "Devils and Dust," about an Iraq soldier's experience.
