Judge To Fire Union Critic: Name Your Sources

Omaha, NE - A Douglas County District Court judge tells a frequent critic of the fire union that he should name the so-called whistleblowers who accuse the union president of being a thief.

David Nabity of the Omaha Alliance for the Private Sector accused union president Steve LeClair of "theft by deception" on a radio program last October. He said LeClair sometimes didn't show up for work and falsified his time records, and spent work time on union duties.

LeClair sued Nabity for defamation of character and demanded that Nabity disclose where his "information" came from. Nabity refused, saying he was protected by the Free Flow of Information Act, known as the Shield Law.

The judge said the Shield Law did not apply to Nabity and wrote: "the primary purpose of Nabity's research and statements was not informing the public discourse, but instead an attempt to further his own political views and ambitions."

He ordered Nabity to respond to LeClair's request for names "within two weeks."

Nabity referred KMTV Action 3 News to his attorney. His attorney said he would comment after he read over the order.
