Justices say home healthcare aides not entitled to minimum wage, overtime
The Supreme Court decision on a rule for "companionship services" could prod Congress to amend the law.
By David G. Savage, Times Staff Writer
June 12, 2007

WASHINGTON — The nation's home healthcare aides are not entitled to minimum wages or overtime pay under federal law, even if they work for private employers, the Supreme Court ruled Monday.

The 9-0 decision, which keeps in place a long-standing rule that denies minimum wages and overtime pay to those who provide "companionship services" at home, could trigger a move in Congress to amend the law.

With an estimated 1 million workers assisting the elderly and the disabled in their homes, unions and civil rights groups had urged the justices to scrap the rule; they say it deprives many of the nation's lowest-paid workers of a living wage.

They say a large percentage of these aides are women and minorities who often work all-night shifts. Yet, under federal labor law, they are viewed the same as part-time baby sitters.

5. Oh, please.
The only America you know is the golden one created after the depression by the New Deal. THAT's what's being dismantled. But up until then? Not so much. Our American past is kinda spotty. What about our future?

We might want to ask what is the purpose of this nation? "The business of America is business." Uh huh. That's what we DO. That's how we keep BUSY. WHY do we do it? The purpose of a business is to make a profit. But what is the purpose of a NATION? What is the purpose of THIS nation? Do we exist to facilitate corporate enterprise? Because that's how it seems now. We are sacrificing citizens for corporate profit. Is that what this nation is meant to do?

I'm not sure what it is now.

The one's on GOV. contracts? Or in general?

10. Not even in some cases...They get paid by the day, a day is 24 hours
But it is one lump sum, not $1.00 per hour for 24 hours...etc.

7. These Justices Are Paid Whores Themselves So...
...no wonder they have no respect for people who do legitimate work. Look, they are pigs, they made the courts a joke the minute they elected Bush illegally. And since the last three nominations to this court, face it these embarrassments to humanity are Bu$h tools who LOVE to give legal head to idiotic neocons and would do it for free and often do. They could care less about anybody but themselves and their rich buddies, they have no problem to screw the honest worker, the sick, the disabled and elderly and are happy to use the law to screw anybody who is real.

I detest the SCOTUS. I have a fantasy that to me is wonderful and funny; I wish that thousands of people would gather at the supreme court steps, turn their backs to it and then gave them a mass mooning on cue.

8. And yet the IRS will hound these people incessantly if they fail to
report every stinking penny...

meanwhile, in another universe, corporations get subsidies out the wazoo and skip out on what little tax burden they might incur...by moving headquarters to a mail-drop in the Cayman Islands :eyes:
