He either lied yesterday or back in June, but Lie he did and I believe an obstruction charge could easily be made as well. If he corrects his testimony to say the plan discussed with the gang of eight was indeed the Terrorist Surveillance Plan then he lied in June and an aside is that he intended to coerce a sick man into doing an illegal act.
