Bush is likely to recess appoint Chertoff as Attorney General, breaking deal with Senate leader Harry Reid.

Michael Chertoff, the co-author of the USA PATRIOT ACT and the man behind the massive failure of FEMA during hurricane Katrina, could be recess appointed without the consent of the 110th Senate.

Shortly before the Senate broke for recess in August, Bush and Senate leader Harry Reid struck a bargain concerning Bush’s dubious recess appointing practices. Reid promised not to block some of Bush’s judicial nominees during the next session, and in return, Bush would not install any recess appointees to vacant positions while Congress was in recess. That may all change now with the resignation of current AG Alberto Gonzales.

President Bush, it has strongly been suggested, is going to claim "exigent circumstances", breaking his deal with Reid not to recess appoint anyone, and install Michael Chertoff as Attorney General, sans any vetting by the Senate.

5. Reid was a stupid, foolish man for believing ANYTHING that Bush says.
His word means NOTHING.

In my opinion, if this happens, it just makes Reid look bad. Everyone already knows what a snake Bush is. This will just prove that Reid is inept and not responsible enough to hold his office.

He let the Fox guard the Hen house while he left town.

An attorney general is obviously an example of "Extrordinary circumstances." Them Democrat Party leadership members are too busy panderin' to activists on the internets than to care about the security of the AmeriKKKan people. This is a time of terra, and Democrat politicians want to distract us from it. Our country needs an attorney general, and instead of subjecting him to Democrat partisan Senators, I appointed him myself.

30. It looks more like an opinion piece than credibly 'sourced'
although, it's good to get that opinion out there. Who knows what this Democratic leadership is thinking? They need to be ready to fly to D.C. and open shop.

9. Senate needs to "convene" TODAY.
Reid needs to have a couple of nearby Dems go to the Senate chambers RIGHT NOW and gavel them in so that the Senate is not in recess. IIRC this can prevent recess appointments.

If Reid doesn't make that happen, he should resign for EVER making a deal with the White House psychopaths.

I'm sure that Senators Byrd and Webb would be happy to oblige.

I wouldn't put it past Bush to attempt what would be a convoluted and self defeating end run, but I've heard other speculation mentioned, as well, from various cable news talking heads - 1. leave the acting AG in place w/out a formal appointment for as long as possible, 2. put up a (R) Senate alumnus/a to smooth the confirmation process,
3. nominate Chertoff straight up and take the lumps.

:shrug:

It'll be an interesting couple of weeks.

24. Yeah, this is crap.
Gonzales hasn't resigned, he's only announced his resignation, effective in mid-September. AGAG probably won't even be gone before the Senate drags him before yet another perjuring session, just for fun.

And while Chertoff has been running good interference for the Bush Administration, that's just because he's a good German following orders. He doesn't appear to me to be a part of the inner criminal conspiracy which has been ongoing since 1999.

If Gonzo were to suddenly resign tomorrow and give Bush a couple days to break his agreement with Harry Reid and appoint someone when he said he wouldn't, the new appointee would almost certainly have to be one of the grunt-work people running the day-to-day criminal operations of the Bush Administration, someone few of us have heard about. I wouldn't be too surprised in that case if it turned out to be one of his political advisers like Karen Hughes, but much more likely it would be a shady DOD-type guy nobody knows.

The AG should be a current or former G-man (or woman), Federal prosecutor or U.S. attorney with a sterling reputation. Considerating this Administration's reputation for secrecy and dishonesty, finding a replacement for Gonzales might be like looking for a needle in a haystack.

Let Chertoff stay at DHS. Put somebody like Patrick Fitzgerald at Justice - or Fitzgerald himself.

Clearly he can't do a "recess" since Congress will be back before Gonzo splits.

But, he'll have to appoint an interim AG, to hold down the fort while a new AG goes through the confirmation hearings.
