Spitzer Has Not Been Charged With Anything
legally speaking, no crime has been committed.

however

don siegelman sits in jail

karl rove, harriet miers, josh bolton, and condi rice all run around free after ignoring subpoenas that mukasey refused to investigate.

scooter libby runs free after a presidential pardon after being found guilty of crimes.

at this point the GOP is trying to criminalize sex. until spitzer has been charged, NO CRIME HAS BEEN COMMITTED.

1. "until spitzer has been charged, NO CRIME HAS BEEN COMMITTED"
Edited on Tue Mar-11-08 10:45 AM by Orrex
I'm not sure that's correct.

Without commenting on the particulars of the case, if a person breaks a law, then a crime has been committed whether or not that person is ever charged.

Rove, Miers, Bolton, Rice et al have committed crimes (far worse than any that Spitzer might have done), yet none of these criminals has been charged.

4. my point is simply a reminder
he hasn't been charged with a crime, so he is not guilty of a crime

kinda how republicans said scooter libby was guilty of no crime when he committed and was convicted of perjury.

technically speaking, spitzer hasn't been charged with anything. no crime has been committed in the legal sense of the word.

rather than going on the defense about spitzer, we need to be reminder ourselves and putting it out there that he hasn't been charged with a crime, so he's only admitted to cheating on his wife.

give the republicans nothing, but take from them everything.

7. "Not guilty" is correct.
technically speaking, spitzer hasn't been charged with anything. no crime has been committed in the legal sense of the word.

Is that accurate? It strikes me that the crime precedes the charge, but you seem to suggest that it's the other way around, which would be a frightful state of affairs!

I don't mean to quibble about the minutiae when, as you rightly suggest, republicans have been screwing the system with impunity.

8. I'm saying
and I'm a Deaniac, so I agree with howard. the best defense is a good offense

repubs want to put impeachment back on the table, fine. lets talk impeachment

repubs want to talk about improper affairs, fine lets talk about these things

lets air out all the dirty laundry. instead of us running around, "WOE IS ME WOE IS ME, ELLIOT IS A CRIMINAL HE DISGRACES US, YADDA YADDA YADDA!!!" look, we clean our own house. no one needs to tell us how to do it

but if repubs wanna step up and start their little shit, especially with don siegelman sitting in jail, then fine

lets have that impeachment discussion. lets have that discussion about how the Department of Justice prosecutes people.

so far all spitzer has done is admit he cheated on his wife. he hasn't admitted to any crimes, he hasn't been charged. innocent until proven guilty.

9. If a tree falls in the woods and no one hears it does it make a noise?
If there are no charges there is no crime...

6. yeah
unfortunately thats not an impeachable offense, or the idiot sitting in al gore's office in the white house would be impeached.

however, if repubs want to make impeachment an issue and put it back on the table, I'm all for that.

10. I'm starting to feel like Nicholson in "The Departed"
I'm not excusing spitzer's actions. but I'm not going to condemn the man either.

or as nicholson put it, "what I'm saying to you is this. when you're facing a loaded gun, whats the difference?"

the repubs have the loaded gun aimed at us. so if they wanna talk impeachment, lets talk impeachment.

they wanna talk about DOJ investigations, lets talk about DOJ investigations.

all they're doing right now is criminalizing sex and trying to impeach a sitting governor for spending his own money on a hooker. no charges have been filed and he hasn't been charged with any crime. other than just being a cheater with a horney streak. but hey, so was FDR. I'll forgive the man his weakness there.

otherwise its just a naked grab for power from the people who continue to keep don siegelman as a political prisoner.
