Why did Kucinich not vote to overturn Bush's veto?

Why did Kucinich not vote to overturn Bush's veto?
Does anyone know why Dennis Kucinich voted "no" on The Intelligence Authorization Act today, and declined to help try and override the Bush veto of the water-boarding ban? There were three Dem "no" votes: DK, Waters and Marshall.

I will assume until I hear otherwise that there was some good reason for this, but I don't know what it is. What up?

5. Kucinich is seeking an impeachment
By stating that water-boarding is "now" illegal, this would effectively state that it was not torture before the law was passed. Torture is already illegal by our laws. Stating water-boarding is illegal is redundant.

8. He has not made a statement as of yet...
This is my best guess based on his past record of voting. If the veto was overturned, no one can be held accountable for the crime based on its original status.
