Prosecutor at the Hague indicting Baschir of the Sudan

Sorry if this has already been posted or is old news.

On Monday {Chief Prosecutor Luis Moreno Ocampo} ordered the arrest and made the indictment against the African dictator public: genocide, crimes against humanity and war crimes are the charges against Baschir (more)

The president of Sudan and commander in chief of the military will be called to answer for the worst war of this time, the slaughter in the Darfur province of Sudan, which is about as large as France.

Now {Ocampo} must persuade the grand jury of three judges to agree to issue the indictment and the warrant against the president. He was able to succeed at that against two of Baschir's top officers last year.

The Hague awaits.

Sudan, apparently, did not ratify the treaty that would give this court jurisdiction over Baschir, so, according to The Spiegel, it will be suspenseful as to whether the court can really try him. Also, the U.N. General Secretary, Ban Ki Moon, is concerned that the court's action could interfere with efforts to bring peace to the Sudan. A word from New York could stop the court according to Der Spiegel.

1. Whether or not the ICC has jurisdiction depends --
The person charged doesn't necessarily have to be a citizen of a cosigner nation:

Under the ICC Statute, the ICC has jurisdiction over nationals of non-parties in three
circumstances. First, the ICC may prosecute nationals of non-parties in situations
referred to the ICC Prosecutor by the UN Security Council.1 Secondly, non-party
nationals are subject to ICC jurisdiction when they have committed a crime on the
territory of a state that is a party to the ICC Statute or has otherwise accepted the
jurisdiction of the Court with respect to that crime.2 Thirdly, jurisdiction may be
exercised over the nationals of a non-party where the non-party has consented to the
exercise of jurisdiction with respect to a particular crime.3 In either of the first two
circumstances, the consent of the state of nationality is not a prerequisite to the
exercise of jurisdiction.
