Judge Denies White House Request For Stay, Says Miers Must Testify
By Jason Leopold
The Public Record
Tuesday, August 26, 2008

A federal court judge on Tuesday denied the Justice Department’s request for a stay pending an appeal over a decision issued last month that said former White House Counsel Harriet Miers and White House Chief of Staff JoshuaBolten were not immune from congressional subpoenas.

The Justice Department went back to federal court last week to urge U.S. District Court Judge John Bates to issue a stay of the order he issued last month pending the DOJ’s appeal of his ruling.

Bates, however, denied the request. His ruling means Miers will have to appear before the House Judiciary Committee to discuss to testify about the role the White House played in the decision to fire nine U.S. attorneys in late 2006. Additionally, the committee sought an inventory of documents from Bolten related to the attorney purge. Bates said the administration would have to fulfill that request.

“The Court will deny the Executive's request for a stay,” Bates ruled Tuesday. “Hence, the Executive should respond to the document aspect of the subpoenas by producing non-privileged material and identifying more specifically the materials it is withholding on a claim of executive privilege.

3. The Judiciary Is The Only Functioning Branch Of Congress
The Founders did a good job of insulating it.

5. Rut Roh...
Bates was supposed to be bought. What the hell? But this is very good news and long, long overdue. Now let's see how Conyers plays this...no more stonewalling, it's time to haul these toadies in front of the public and start exposing the corruption they have enabled...or throw them in jail until they do.

I suspect that Karl is not feeling too good right now, he's next. I don't expect a lot to happen between now and the election, but thi sets the table for what happens afterwards...especially if the repugnicans lose big in November...the walls are starting to crumble around this regime...and the door is starting to open to get accountability..something that Joe Biden made specific mention in his speech last Saturday (and no one seemed to pick up on it).

Remember, anyone indicted by this regime will be "Scootered" to ensure their silence, thus the groundwork is being laid for how to move forward after 1/20/09.
