If the Patriot Act allows for appointing and firing Federal
prosecutors while bypassing Congress, then this part, at least, should be amended.

I hate to think of a scenario where prim Harriett were s supreme court justice and this case would come in front of her as a challenge to executive power, or something.

to take this to the SCOTUS?

if they allow this to stand, they can add similar riders to any legislation they want, and END all senate confirmation of ANY presidential appointee.

follow the logic; it's very simple

pick any clause of the constitution which requires legislative oversight of the executive branch

which one will he choose to supersede next?
