Democrat Al Franken is headed to court to demand he get a Senate election certificate after failing to get one from Minnesota's governor and secretary of state.The petition he is filing Tuesday with the Minnesota Supreme Court seeks to force Republican Gov. Tim Pawlenty and Democratic Secretary of State Mark Ritchie to issue the signed certificate. His campaign asked both officials for the document on Monday. But they said state law doesn't allow them to deliver one until a lawsuit filed by Republican Norm Coleman is settled.
BACKGROUND: Officials nix request in Minnesota race
Coleman is contesting the recount that finished with Franken up by 225 votes. Franken attorney Marc Elias says the campaign isn't trying to stop the court case from going forward.
He says Franken should be able to serve in the Senate while the lawsuit moves forward.
