UN Special Rep on Torture Manfred Nowak is talking about it, says Obama should investigate. Says there is enough evidence to make a case against Rumsfeld/Bush.

This is not some lunatic either, he's the expert on torture around the world.

7. I used to feel that way too - but
I try to catch his show everyday. He is gooooood. I put him right up there with Keith and Rachel for really reporting the news stories that others aren't.

He does have kind of a goofy personality - but heck, I'll take it.

10. Rick Sanchez reminds me of some of my male cousins of the same age.
He is a little goofy and sometimes, a little credulous, but he does take an interest in stories sometimes which shows he has a pulse there, somewhere. :)

BERLIN (AFP) — The UN's special torture rapporteur called on the US Tuesday to pursue former president George W. Bush and defence secretary Donald Rumsfeld for torture and bad treatment of Guantanamo prisoners.

"Judicially speaking, the United States has a clear obligation" to bring proceedings against Bush and Rumsfeld, the United Nations Special Rapporteur on Torture Manfred Nowak said, in remarks to be broadcast on Germany's ZDF television Tuesday evening.

He noted Washington had ratified the UN convention on torture which required "all means, particularly penal law" to be used to bring proceedings against those violating it.

"We have all these documents that are now publicly available that prove that these methods of interrogation were intentionally ordered by Rumsfeld," against detainees at the US prison facility in Guantanamo Bay, Cuba, Nowak said.

"But obviously the highest authorities in the United States were aware of this," added Nowak, who authored a UN investigation report on the Guantanamo prison.

11. Bush/Cheney both have admitted they tortured on camera.
The only thing stopping their prosecution is the profound dysfunction of our government.

Obama has a whole buffet to deal with and, I'd understand if he didn't want his whole first term overwhelmed by this issue. I'd hate it, too, in a way. But there has to be some middle ground between being taken over by the issue and letting these felons skate. We can't do that.

16. I would be interested to hear someone from the administration really attempt
to defend themselves in court using Gonzalez's tortured and mis-shapen definition of torture (permanent damage to vital organs). It would be clear to everyone that these guys knew what they were doing and how absurd it is to be debating was torture is and isn't.

If you're not sure if it's torture, it probably is and you probably shouldn't be doing it.

Thing is...if this subject gets investigated in a transparent way, we're going to hear about a lot more cases and a lot more abusive treatment than waterboarding a couple of guys. Tip of the iceberg. I think there would be so much ugliness (dozens of abu ghraib deaths, suppressed videos, rendition, secret prisons) that I could see top officials (even progressive ones) saying to themselves that to expose all of this would not be in the national interest. They may NOT do it in a transparent way but instead limit the investigation to a few prosecutable cases. The full extent, the truth, would be hidden but there would be some accountability.

Tricky business...get it out in the open to demonstrate that we are turning a page in America (and to uphold the constitution)...or...hide the facts and put on a show that achieves the most and minimizes the risk.

17. I read a report from Clive Stafford Smith that said we have 27K detainees
overseas. Gitmo is only the top of the tip of the ice berg.
