Supreme Court upholds gun-control law
The 7-2 decision strips the right of anyone convicted of a domestic violence crimes -- including a misdemeanor -- to own a firearm.
By David G. Savage
February 25, 2009
Reporting from Washington — The Supreme Court upheld the broad reach of a federal gun-control law Tuesday and said that no one who has a conviction for any crime of domestic violence may own a firearm.

The 7-2 decision strips gun rights from tens of thousands of people who were convicted or had pleaded guilty to an assault against a spouse, a live-in partner, a child or a parent. These crimes include not just felonies, but misdemeanors.

"Firearms and domestic strife are a potentially deadly combination nationwide," Justice Ruth Bader Ginsburg said.

Gun-control advocates and law enforcement officials praised the ruling. On average, more than three people are killed each day by domestic partners, according to the Brady Center to Prevent Gun Violence. About 14% of police officers who are killed in the line of duty die in response to a domestic violence call, the group said.

(Maybe I should have made this a poll asking if it should be described as "HUGH" or "SERIES.")

1. (shrug) They've already deprived themselves of their manhood by hitting women...
I fail to see why they would be upset by being deprived of their guns.

3. well I agree with that 100%...
"no one who has a conviction for any crime of domestic violence may own a firearm." Yeah! There is nothing wrong with that at all.

If any one has a felony charge, they should not be allowed to own a firearm IMHO.

22. I think Antonin told him to vote for chicks.
Of the two, only Antonin could have calculated how a dissenting vote from Slappy would remind people about his history with women's rights.

In fact, I bet someone had to stop him from reflexively voting with Antonin.

36. I had a back ground check which includes a search for any domestic abuse records.
It clearly states on the back ground check application that you can't purchase a gun from an FFL dealer if you have any domestic violence, mental problem, felony record history or a dishonorable military discharge.

15. It's to imply that freepers will use a Supreme Court ruling to try to prove that President Obama
is trying to take guns away.

It doesn't matter that this ruling was in no way affected by anything President Obama said or did.

21. So who is going to tell the police that some guy just convicted of domestic
violence has a cache of guns in the closet. The abused spouse?

They should have gone further and made it a capital offense if the person then takes revenge on the spouse by shooting her for reporting that the batterer is is possession of guns.

28. The fears about a crackdown on reloading don't really pertain to the Obama administration, IMO
but stem from the actions of a group that is lobbying to etch serial numbers on ammunition (aka "microstamping"), register all ammunition lawful purchasers buy by serial number, and require all non-serial-numbered ammunition be destroyed by a certain date. That would pretty obviously put the kibosh on reloading, and also would probably dramatically increase the price of ammunition.

Here's the group's website:

http://www.ammunitionaccountability.com/

FWIW, it is no surprise that most of the money and lobbying behind the proposal comes from a company that makes equipment to etch numbers on bullets and cases, but the repubs at the Brady Campaign have picked it up as well.

The fears about "taking guns away" come primarily from VP Biden's and AG Holder's history as crusaders against "assault weapons" (aka the most popular civilian rifles in America) in the 1990's. My own hope is that President Obama is too smart to pull another 1994, but the MSM really wants another "assault weapon" ban, and some worry that they might pressure Congress into sending one to the President's desk.

35. If ONE person's life is saved because of this law, it is worth it
If ONE person is NOT assaulted by their gun-owning, over-testeroned spouse because of the fear his guns will be taken away, the law is worth it, if ONE person who has beaten his wife is prevented from owning a gun for the purpose of killing his spouse, the law is worth it.

Now, the problem is how do you get the guns away from these criminals?
