Whistle blower deposed in Schmidt versus Krikorian election complaint

Ohio Second District Congresswoman Jean Schmidt, R-Cincinnati, filed nine election complaints against independent candidate David Krikorian concerning the 2008 election in May this year.

Krikorian opposed Schmidt in the Second District Congressional race as an independent in 2008 and is seeking the Democratic nomination for the 2010 race in April. The complaints focus on Krikorian's statements during the election stating that Rep. Schmidt was taking money from organizations related to the Turkish government in exchange for denying the occurrence of what Krikorian called the Armenian Genocide at the hands of the Turks during World War I.

The complaints also relate to Election Commission records on campaign contributions Schmidt received from the Turkish American Heritage PAC and the Turkish Coalition USA PAC.

Since filing the complaints, Schmidt's counsel has withdrawn four complaints, and an Ohio Elections Commission three-person panel decided there was probable cause to hear the remaining complaints on Thursday, Aug. 13. The five remaining complaints will be reviewed by the entire Commission on Sept. 3

8. Listening now.
That guy objecting is certainly annoying. Apparently his objections don't stop the proceedings.

13. It's probably Bruce Fein.
He is Mean Jean's lawyer. That was one thing that was brought up in the in-between interviews. Bruce objected to everything.

14. I'm not familiar with these kinds of proceedings.
The closest I've seen is trials on TV and in movies and those probably aren't accurate reflections of the real world.

What I find interesting is that there is no one sustaining or overruling the objections. The questioner seems to simply ignore them.

Ms Edmonds appears to be somewhat exasperated by the objections at the beginning of the video, LOL.

28. Google "flash downloader" and pick one
There are tons of apps for the exact same thing.

This one might do the trick, but of course and as always, scan the vile for viruses since the source is basically unknown.

32. Two easy solutions...
I use both of these:
Download Helper addon for Firefox...
https://addons.mozilla.org/en-US/firefox/addon/3006
Or, if you want to do it without installing anything
on your machine, you can use the transload (enter a link) feature
on this site: http://www.mediaconverter.org/

21. 2nd video clip also covers blackmailed congresswoman.
Apparently her husband and his influence was a big factor also in her being targeted for blackmail, as well as the district she was in where there was a lot of Turkish lobbyist activity.

This clip is pretty meaty. Also alleges that Tom Lantos was pretty heavily indicted in giving away secrets to both Israel and Turkey.

which implied that perhaps that was a source of blackmail that might have happened much like the blackmail that happened with the sitting congresswoman that was talked about more earlier.

20. For those stalwart faithful that follow Sibel closely, what has the fallout been
from her deposition. Anyone in msm planning a report or investigation or article? Any congressman plan on opening hearings to discuss her serious allegations of corruption and espionage? 60 minutes planning an expose?

26. Perhaps an interesting place to ask Krikorian questions... He has a debate scheduled...

at the Anderson Center in Anderson Township that was supposed to be a debate on health care. He's reserved that, though Schmidt's spokesperson says she's not available that day. Perhaps if he shows up anyway to give a speech, etc. there, that might be a good place to ask followup questions to him on the Sibel Edmonds' deposition.

30. A bit of explanation about what this proceeding is, and why there are so many objections
Edited on Tue Aug-25-09 07:16 AM by HamdenRice
The American legal system is unique in lots of ways, but one of its strangest (from an international perspective and maybe even from the non-lawyer's perspective) is the process called "Discovery."

Law reformers in the earlier part of the 1900s decided to reform litigation (court cases) by making it easier for both sides to gather evidence -- even from the other side. That process is called discovery.

The idea is that court cases wouldn't involve surprise witnesses and evidence, but would be the culmination of a long process of both sides learning everything about the case long before it comes to court.

In discovery, you are allowed to go through your opponents files (or because of business competition issues, more precisely your lawyers are allowed to go through your opponents files). Your lawyers can ask your opponents questions, which they have to answer.

And you are allowed to have a trial-like questioning of witnesses outside of the court. That's called a "deposition" and that's what Sibel is undergoing here.

Throughout discovery, the judge is not directly involved. If the lawyers get into a grudge match, then they go to the judge to decide things. Also the judge can limit or expand the scope of discovery.

A lot of information that is uncovered is useful for both sides to understand what actually happened and what the issues are, but much of that information is not actually admissible in court (under the rules of evidence). The parts of the deposition that are admissible may be used in court later -- or the parties will just "replay" the question and answer at trial.

Many of the questions and answers in a deposition are inadmissible, or the questions are asked incorrectly but because the judge isn't involved in the deposition, the lawyers will say "objection" but then the question is asked and answered anyway.

That's called "preserving" the objection.

This encourages lawyers to object to almost everything on the off chance that later on, that information can be prevented from being admitted to trial.

This makes taking depositions (and listening to them or reading them) extremely annoying.

I've just started reading the deposition, and you can see that Fein is objecting to everything, objecting to Marino even being a lawyer, and objecting to Sibel being there. He's trying to preserve the possibility that the entire deposition will be inadmissible.
