and for the 100th time,

1) the meme is "FALSELY yelling fire in a crowded theatre" not "yelling FIRE" the "falsely" part is key
2) it doesn't matter if it is, because that standard, under the Schenck case was superseded by the brandenberg standard (see both scotus cases) and schenck is NOT law of the land
3) the falsely yelling fire thang was used as a justification to prosecute a WAR PROTESTOR.

if you want to know what the standard is, then read brandenberg. but , in brief, this doesn't meet it.

it's based on a lie, so there is a comparison. and if it were really true that our president is as evil as hitler, it would cause many people to rise up and take (possibly violent) action, which is why I compare it to yelling fire in a theatre or inciting a riot.

9. it's not a comparison of any worth

1) the reason "falsely yelling fire" in a crowded theater was seen as criminal was because it creates an imminent risk of bodily harm. at the time of that decision (this is before modern fire prevention, etc.) there actually were numerous cases of people dying in such fires.

the imminence is key. it would be illegal (reckless endangerment) to do this IN a crowded theatre. if an hour after the theatre closed, i started yelling "there was a fire in the theatre" falsely, there would be no criminal liability.

2) falsely yelling fire has little to NO content value. iow, you are not expressing a political opinion, or an opinon whatsoever. you are intentionally trying to create a stampede, or recklessly doing same.

3) whether or not it's a "lie", comparing obama to hitler (much as bush was compared to hitler) is a CLASSIC example of political speech, it is clearly OPINION (which really cannot be a "lie" at least in the legal sense) and furthermore, except in very limited circumstances, telling lies is not illegal (examples where it is illegal are in fraud cases, or lying to federqal agents i n the course of an investigation, etc.)

there is no comparison. comparing obama to hitler, while stupid, is EXACTLY the kind of speech that the 1st amendment was designed to protect.
