Plan To Ban SD Schools From Suing State Defeated
PIERRE, S.D. - A South Dakota Senate panel has rejected a
proposed constitutional amendment that would have prohibited public
school districts from suing the state.
The measure was proposed after about half the state's school
districts gave financial support to a lawsuit challenging the
constitutionality of South Dakota's system of funding schools.
The proposed constitutional amendment would have prevented
schools from suing the state or paying for such a lawsuit.
Sen. Larry Rhoden, R-Union Center, said school districts should
not be allowed to spend taxpayers' money to sue the state in an
attempt to get more state tax dollars.
