Can Arizona Afford to Implement S.B. 1070? By Seth Hoy (GONNA COST EM)


According to the fact sheet:

* Law-enforcement agencies would spend between $775,880 and $1,163,820 in processing expenses;
* Jail costs would be between $21,195,600 and $96,086,720;
* Attorney and staff fees would be $810,067 - $1,620,134;
* Additional detention facilities would have to be built at unknown costs.

And that’s just in Yuma County alone. Yuma County has a population of 200,000 and is only one of fifteen counties in Arizona. The above implementation cost could reasonably be magnified to consider the cost for all Arizona counties.

In addition to implementation costs, Gov. Brewer should also consider the costs of defending the state against potential lawsuits on behalf of legal immigrants and native-born Latinos who feel they have been unjustly targeted. For example, the city of Farmers Branch, TX, passed an ordinance in 2006 (now overturned) which required landlords to verify potential renters’ immigration status. To date, the city has spent $3.2 million in legal fees defending itself since September 2006—and the bill is expected to exceed $5 million by the end of fiscal year 2010. Hazelton, PA, is also engaged in a similar fight over rental ordinances.

2. They have gone up
Earlier this month, Phoenix implemented a new tax on Food Items. Not pre prepared food items, but all food in general. We have an upcoming vote for another tax increase for Education and Public Safety. I am sure that will pass too. I just wish they didn't combine the two items together. Education I would vote on (as long as no money went to private/ religious/ charter schools). Public safety, they installed a bunch of photo radar cams all over the interstates and on red lights through out the valley; they can use that money to fund public safety.

7. Can I sue the state of Arizona?
In the bill, the text states:

"A PERSON MAY BRING AN ACTION IN SUPERIOR COURT TO CHALLENGE ANY OFFICIAL OR AGENCY OF THIS STATE OR A COUNTY, CITY, TOWN OR OTHER POLITICAL SUBDIVISION OF THIS STATE THAT ADOPTS OR IMPLEMENTS A POLICY THAT LIMITS OR RESTRICTS THE ENFORCEMENT OF FEDERAL IMMIGRATION LAWS TO LESS THAN THE FULL EXTENT PERMITTED BY FEDERAL LAW."

Now, this strikes me as an interesting part of the law because, essentially, anyone can sue any official or agency in Arizona that "adopts" a policy limiting the enforcement of federal immigration laws. It sounds like Arizona is opening themselves up to a ton of lawsuits. Furthermore, if anyone in the US calls a police station in Arizona with a tip that someone is an illegal immigrant and that police station doesn't attempt to pursue the tip, I guess we can sue that police station.

This could be a lot of fun...you know, if only actual people weren't being hurt by it.

8. If you live in Arizona you would have standing to file a lawsuit.
You would probably have to show how it effects you beyond stating you are an Arizona resident.

If you were stopped because of this law you would have standing.

I'm not a lawyer.

11. In most cases I think you would be correct...
But with the wording of the law, I don't think the person necessarily needs to be an Arizona resident. Furthermore, I don't think you would need to show how it effects you personally.

While normally you have to show some damage, it sounds from my reading that the result of the suit would be the payment of lawyer/court fees and that, once you prove that the government official violated the new law, that official will be fined with the money going to some government agency. Basically, it sounds like the person suing wouldn't get damages, but only attorney/court fees (which, if you are representing yourself, could make for a nice profit).

As for needing to be an Arizona resident, I think there is an argument to be made that it isn't a requirement here since you aren't suing for actual damages or harm to yourself, but rather a "societal harm" in a sense.

10. What's so funny is that we have a vote on a 1 cent sales tax in May and all the repugs are whining
about that! They are all over the place saying they will vote NO.

This state is already broke, I have no idea where Brewer thinks she can find the funding for her racism.
