Lincoln did it during the Civil War, and the Supreme Court properly smacked him down for it, albeit some time later. Bush did it for his own political ends, and we have all agreed to overlook that because some very important people were very scared, so violations of the Constitution have been deemed legitimate.

Whatever is being threatened by the TSA and its ham-handed security tactics, it isn't really the United States as formerly understood.
