On Dec. 23, 2010, she made the first payment, due Jan. 1. The Times continues the sequence of events:
The next month, she made the February payment over the phone. Weeks later, the money had not been withdrawn from her bank account. After Bullington asked the bank about it, a representative told her she had punched in the wrong routing number. In March, the bank kicked the couple out of the modification plan.

Bullington wrote to Bank of America President Brian Moynihan. According to The Times, she got a response from an assistant, Ana Olivera, saying the foreclosure could not be stopped because the payment due Jan. 1 had been made in December.

"In accordance with the Trial Payment Letter dated December 15, 2010, it indicates that if you are not able to make each payment in the month in which it is due, you will not be eligible for a modification under the Home Affordable Modification Program," the letter said.

To its credit, after The Times wrote about the Bullingtons' problems — and the couple hired a lawyer — Bank of America said it would take another look at their account.

Oh, how nice of BoA to "take another look"

4. No, the response of regular DUers was heartening -- but first came a drive-by unrec
...which means, it was someone taking the bank's side.

Virtual head-shaking ensues.

10. Could also mean that someone hit the wrong button. I see posters all the time
saying they hit the wrong button.

2. For most of the history of mortgage lending, prepayment was the big fear
That sounds almost quaint now.

5. So, they were placed in a position where they absolutely had to
make payment on the first, not a day before and not a day after.

To restrict anyone from paying their mortgage in the previous month leading up to the 1st is beyond the pale. The banksters are determined to find every way possible to extract any semblance of wealth from people just trying to survive, including taking their homes when they dare to pay on any day other than the 1st.

We should be tearing Wall Street down brick by brick.

7. from the article, looks like the messed up routing # for the Feb payment gave BoA "justification"
for their eventual lame-ass reason.
