Family files suit in Albuquerque crash that killed 6-year-old boy

The family of a 6-year-old boy who died after an on-duty Albuquerque (N.M.) police officer responding to a possible assault slammed into his mother’s car has filed a lawsuit against both the officer and the city.

Officer Johnathan McDonnell was traveling nearly 80 mph to a call for help around 6 p.m. on a Monday in April when his cruiser collided with Antoinette Suina’s car as she turned left onto Indian School from southbound Eubank.
Joel Anthony Mumaw, 6, later died in a local hospital. His 9-year-old sister suffered extensive injuries.

McDonnell had been disciplined in at least six driving-related incidents during his nine years with APD. Those include what internal police documents say were five preventable crashes and an unauthorized pursuit, which took place less than a year before the fatal wreck.

The lawsuit cites data released by the police department showing that of the 304 crashes APD officers were involved in during 2016,
48 percent were the department’s fault,
and 125 of them were preventable.
