Ok, now what?...

Project into the short time future.

It's found that 45 has Russian help in the election.
It's found that he obstructed investigation.
It's found that he has violated the emoluments clauses.
It's found that he violates women at every chance.
It's found that it goes deep to include high ranking Republicans.

Now what?...

Do we have to go through the impeachment process?
Is he arrested on the spot? Are they? (the high ranked republicans) arrested also?
Are all the "policies" he enacted revoked?
Do we return to a set point of policy? (Kinda like a reboot to the last known working environment)

How are we going to proceed?
Any knowledge would be appreciated.

I'll sit back and let the discussion begin.

Nothing Republicans do matters to their base any more.

That 35% will do anything to keep them in power, and there is another 10% that even though they may be disgusted with Republicans, will still never vote for Democrats and will instead just sit it out and complain.

Republicans know as long as they can keep throwing red meat to that base they can get away with anything.

Cynical? Probably
Reality? Definitely.

doesn't matter how many felonies were committed in the process of becoming president. the electoral college voted for him and the house of representatives confirmed that vote, and there's no constitutional process to erase that.

imho, republicans will never impeach donnie, period. in the unlikely event foxnews turns against him, republicans in congress will quietly convince donnie to declare victory and retire early having accomplished everything he wanted to.

assuming democrats retake the house, we might impeach him then. that depends mostly on a cold political calculus of whether or not it helps democrats in congress extend their gains in 2020, and also to win the white house. not much to do with any greater principle. if it plays well for democrats to let donnie stay as an albatross around republicans' necks, then that's what they'll do.


as for an indictment, it's never been tested. my hunch is that mueller would indict; donnie would challenge; the supreme court would likely decide that the trial has to wait until donnie's out of office.

of course, it's also possible that a deal might be worked out for him to resign in exchange for a pardon.

but if he was found to be illegal from the outset... then what?

I realize there is no constitutional president for the current times but couldn't that be circumvented by proven felonious crimes?

the power to say he never was president simply doesn't exist, no matter how many crimes happened along the way.

the best that could be done is he could be impeached and removed and a subsequent president could reverse his executive orders, and so on. in theory, gorsuch could be impeached for similar reasons. and again, in theory, the tax law could be repealed.


that said, many people could go to prison for these crimes.

Impossible to tell at this point, as we don’t know what Mueller has on 45 and his closest associates. We do know for a fact that from Pence on down, they can all be indicted, tried and sentenced. As for 45, the matter of indictment and prosecution is unsettled law, and so we don’t know if Mueller would go the indictment route and let the Judiciary eventually settle the issue.
Mueller has hired the best specialists in money-laundering investigations/prosecutions and in cybercrime issues. They temporarily left very high-paying law-firm partnerships in order to be a part of a historic investigation. And Mueller himself is a tough, smart and decisive leader who needs no more glory or recognition, but has come out of semi-retirement in order to expose the corruption of 45 and his sycophants. It’s the proverbial example, familiar in movies and literature, of the famous character coming out of retirement in order to prosecute the case of his life.

Bottom line, the investigation is in the best possible hands, but it is too early to know what the final outcome will be.

Yes. Or the 25th Amendment. Those are the only ways to remove a President from power outside of an electoral defeat, resignation, or death.

No. Any others can be arrested. There is a debate whether a sitting President can be arrested or indicted. Practically, it doesn't matter, the Secret Service isn't going let anyone, other then themselves, detain the President. There is also the other issue that as CinC, the military is still bound to follow his orders, and while the military is also bound to ignore an illegal order, you can imagine this could create some problems. His "power" can only be removed by what I listed above. Even if he were to be indicted, arrested, and sentenced, unless he was impeached, removed via the 25th, or resigns, he would still technically hold all Presidential power. While the Constitution isn't clear on the ability to arrest or indict a President, it is very clear on how to remove one.

No. His executive orders can be rescinded by the next President though.

No. He is the legitimately elected President from a legal standpoint. Everything he signed is valid unless invalidated through the normal legal process.

We the people can force this criminal from office. We need to for an occupy movement that will sweep the nation leading to a general strike. If we can bring the economy to a halt and cause a massive fall in the markets the ‘ruling class’ would dump trump like a hot pile of sh!t.

It's all theorycraft from here on.

We don't really have any precedent for declaring that someone was never legally the POTUS. I would imagine that it would certainly start a debate about legislation for conspiring with foreign powers to usurp the election. If it's proven possible beyond doubt, it's really no longer possible to ignore from a legislative standpoint.

Tying in with that no precedent problem, I don't think we'd have anything immediately on the books for reversing policy decisions which followed a fraudulent election. Those decisions could certainly be overturned, but that depends on who we'd get after Trump. I really don't see them arresting all high ranking Republicans. It would veer things so far off track, their rabid supporters would be armed in the streets and screaming about a Democratic coup or some nonsense.

It's all cloudy, I guess is what I'm getting at. If we come up with some ruling which declares Trump's presidency invalid from the start, I would imagine his companion on the ticket - Pence - and anyone proven directly involved in any conspiracy or obstruction would be kicked out of office. Probably then kicked into jail for treason or some such. It would be a huge moment in our country's history, which is why I think everyone will be stepping very lightly on how they approach the matter.

My best guess is Trump (at least) goes if all of those things are found to be true, along with any proven accomplices. We could still end up with a VP Pence as President, who knows. Total reversal of policies? Not by default, I would guess, but it would probably become a popular thing to vote on overturning said policies.

I don't think any of it's going to be so easy in the end. The Republicans are fighting to the bitter end for Trump. They're accusing the FBI of having a "secret society" within it committed to preventing Trump from becoming President. Trump himself says he wants to speak under oath to Mueller, which means a grand jury hearing, and his lawyers promptly scrambled to say he was just speaking in the moment. We've got a long way to go, though I think Mueller is starting to tighten the circle.
