and then blow the whistle on Trump, big-time. Trump will threaten to sue, but lawsuits involve discovery. Can Trump stand exposure from such discovery? I guess not.
Just call his bluff. Use one of Trump's tactics and call his bluff. Lay all of the available facts on the public table and rely on expert legal help paid for by the terms of the publishing deal.
That's what I'd do if I were in her shoes. Just go for it. Drop the bomb on him.

(62,444 posts)Daniels is currently litigating the enforceability of the contract she has already signed.
The contract requires all disputes to be exclusively addressed in private arbitration.
So there is no "threaten to sue" or "discovery" involved, if the contract is held to be enforceable.
When you have a contract with an arbitration clause, it does not at all work the way you imagine it does.

Yah, sure.
Have you ever even read the thing you are talking about?
The liquidated damages clause of the contract calls for $1M for each discrete disclosure.
Even if each copy of the book were treated as a single disclosure (as opposed to individual disclosures of each separate fact), then you believe that counsel for some publisher is going to indemnify her at $1M a copy?

I'm sure she'll find someone. And she's clearly fearless and can't be intimidated or slut-shamed, so Trump has few weapons left.
