Her school vowed no penalty for the school walkout. Her teacher gave her an 'F' anyway

A Los Gatos, Calif., math and science teacher says the U.S. Constitution justifies his decision to fail a student on a quiz for leaving class Wednesday for the National School Walkout, despite earlier promises from the superintendent and principal that students would not be punished for participating.

"When a publicly funded school promotes one side of a highly divisive political issue, we undermine the very constitution that protects the right we so cherish," David Kissner, a math and science teacher at C.T. English Middle School, told The Mercury News on Sunday.

The National School Walkout encouraged high school and college students to leave class for 17 minutes Wednesday to honor the lives lost in a Parkland, Fla., school shooting Feb. 14 and to demand stronger gun laws. Tens of thousands of students across the U.S. participated in the event, some with permission from their schools and some without.

The Loma Prieta Joint Union Elementary School District in Santa Clara, south of San Jose, had encouraged students to take part in the walkout.

"I did instruct teachers and school staff to not penalize any students who chose to walk out or give extra credit to anyone who did," Superintendent Corey Kidwell told KNTV. But the father of a girl in Kissner's middle school class said the teacher held a pop quiz during the walkout. His daughter finished as much of the quiz as possible before leaving class for the walkout, but Kissner refused to accept her test and gave her a failing grade, the father told the station.

"Never pull a pop quiz and penalize the kids that wanted to exercise their First Amendment rights," he said. The father told KNTV he's pulling his daughter from Kissner's class and appealing the failing grade on the quiz.

And any make-up process in place was available to this student. No make-up process and is still be fine with the F as long as it was a scheduled quiz.

Many of these youngsters are learning a great lesson in civil disobedience. That often comes with consequences. Even those not participating are witnessing a great lesson.

A pop quiz? Hell no. That’s some bullshit.

Oh, and he held a press conference to make sure he got the credit for his patriotism.

So that whenever the nation's idiots decide that we should teach abstinence - only in sex ed class we can hit them in the goddamn head with that block of Rock.

What pisses me off the most about these people is that that they think the illusion of smart is good enough. Simulacra and Simulation clearly ISNT a book they've read and understood.

Except that is exactly what he did. A schools position on this should be it is the kids choice for an event of this magnitude. Want to march, want to stay inside, your choice. The kids made a choice and the teacher punished them for it, which means he is endorsing ONE SIDE of the argument.

Is to teach critical thinking, ethical decision making and Civics. It isnt. It's purpose is to teach Moral Values and Fucking Obedience (at least according to this piece of shit 'teacher').

Student's father should write a letter to the school authorities, tell them he's proud of his daughter, and that if any explanation is needed by prospective colleges, he'll supply the letter himself. Oh, and Mr. Math Teacher/Konstipitooshunal scholar Kissner's name will figure prominently in that letter.

I am reviving this old post for a very good reason - PLEASE read:

The teacher discussed in the above post from 3 years ago is David Michael Kissner, and when his name is googled this thread is one of the top results. I am hoping this thread (via google) can prevent future parents and employers from putting children at risk!

David Kissner was recently dismissed from his teaching position at our small mountain school district in northern CA. The charges were released via FOIA public records request and can be found here (pages 4-9 are the worst):

In summary... Mr. Kissner was dismissed after multiple charges of providing alcohol to minors, potential grooming behavior, and telling stories of death, dying, mutilation and bodies being blown up to his math class.

Mr. Kissner is a staunch Christian Conservative culture-warrior, and has convinced the law firm “Freedom X” to battle our public school over his dismissal. The Freedom X website has to be seen to be believed:

We are a tiny mountain school district in northern CA with a very small budget. Posting here is one way we are fighting back! We have a small administration - one superintendent and one principal for 500 students in both an elementary and a middle school. For the entire past year, our administration has been occupied with fighting legal attacks from Freedom X and David Kissner.

I truly hope the posts about this teacher on this forum stay active, and that any future employers of David Kissner will find the information linked above. David Kissner has been a total nightmare for our school.

In the dismissal case referenced above, David Kissner requested a hearing. That hearing has concluded and the decision is available at [link:http://davidmichaelkissner.wordpress.com|, as the "Kissner OAH Decision" near the top of the page. The decision was to dismiss him due to his unfitness for service. He has filed case 22CV393046 in the Santa Clara County Superior Court to attempt to overturn that decision.
