...would he have to go thru Senate confirmation?
If Rudy were to become the new AG, could he fire Robert Mueller?
These people are masters at diversion. If this latest Stormy Daniels/campaign finance story is indeed meant as a diversion, look for Sessions to be gone soon.
There is a story moving under the current, in my opinion.

(11,747 posts)as a recess appointment. That gives him 120 days a provisional to do all the damage...before the Senate even takes up his nomination.

(101,698 posts)but I don't think he can do that with someone not already in the administration and having gone through one Senate confirmation already. That's why he was able to slide Pompeio from CIA to State Dept.
IF he CAN do so, there have been attempts (even by Republicans) to prevent recess appointments by a technicality that maintains a few people around to keep Senate in session.

(146,189 posts)I doubt Rudy would be confirmed, and I further doubt that Trump would appoint him. Rudy's timing chain is slipping a tooth on the camshaft sprocket more and more often these days.

(16,646 posts)Now that he is on Trumps legal team, if he was able to actually get confirmed (not really possible hopefully) department rules would require him to recuse himself (Just like... oh... what was his name????)

(3,805 posts)and of course with this GOP, that is entirely possible.

(1,676 posts)The DOJ Conflicts Rule, 28 CFR 45 basically says that any appointee with a political or personal relationship with Trump must recuse.
Therefore, a previously confirmed cabinet officer, if installed in place of either Sessions or Rosenstein, would be required to recuse. The same could be said about almost ANY person Trump may appoint....almost all of the possibilities publicly mentioned, and many others not publicly mentioned, have a political or personal relationship with Trump.
A bit more of an explanation:
