Stormy Daniels attorney Michael Avenatti was sued Wednesday for breach of contract by his former law partner Jason Frank.
Frank alleges that Avenatti violated a settlement agreement that had been reached in December. Under the terms of the settlement, according to the complaint, Avenattis law firm was to pay Frank $4.85 million, with a $2 million installment due by May 14. Avenatti failed to wire the installment, the complaint alleges.
In a statement to TPM, Franks attorney Eric M. George said that Avenattis law firm entered into a crystal clear written settlement agreement to resolve a prior lawsuit brought by Jason Frank, his former law partner.
The settlement agreement was approved by a federal court and was a condition of his law firm exiting bankruptcy, he said. Under this settlement, Mr. Avenattis law firm was required to pay Mr. Frank $4.85 million, all of which was personally guaranteed by Mr. Avenatti.

(14,249 posts)Avenatti may technically be in breach, but no court is going to do anything on this unless and until it's clear the plaintiff tried to secure payment. And suing two days after a payment is due is pretty silly.

But, yes, it seems ridiculous to file a lawsuit when a payment is two days late.

(14,249 posts)Usually, a party is expected to make a reasonable effort to collect after a due date before going nuclear and filing suit. It's not legally required, but it's really waste of time to run to court like this.

(1,216 posts)When one considers the exposure on live camera to million of watchers. Wouldn't even cover hotel & food in a big city, never mind if air travel is also necessary.

(85,917 posts)...Stormy Daniel's and the truth. He never claimed to represent 'Democratic' interests, but I assume we're interested (as individuals and a party) in this president being held accountable for his words and actions.
I think Avenatti has excelled, so far, at representing these, to the benefit of anyone interested in confronting Trump.
