Read The Complaint: Avenatti Sued By Ex-Law Partner For Breach Of Contract

Stormy Daniels attorney Michael Avenatti was sued Wednesday for breach of contract by his former law partner Jason Frank.

Frank alleges that Avenatti violated a settlement agreement that had been reached in December. Under the terms of the settlement, according to the complaint, Avenatti’s law firm was to pay Frank $4.85 million, with a $2 million installment due by May 14. Avenatti failed to wire the installment, the complaint alleges.

In a statement to TPM, Frank’s attorney Eric M. George said that Avenatti’s law firm “entered into a crystal clear written settlement agreement to resolve a prior lawsuit brought by Jason Frank, his former law partner.”

“The settlement agreement was approved by a federal court and was a condition of his law firm exiting bankruptcy,” he said. ” Under this settlement, Mr. Avenatti’s law firm was required to pay Mr. Frank $4.85 million, all of which was personally guaranteed by Mr. Avenatti.”

Avenatti may technically be in breach, but no court is going to do anything on this unless and until it's clear the plaintiff tried to secure payment. And suing two days after a payment is due is pretty silly.

Isn't that some kind of effort?

But, yes, it seems ridiculous to file a lawsuit when a payment is two days late.

Usually, a party is expected to make a reasonable effort to collect after a due date before going nuclear and filing suit. It's not legally required, but it's really waste of time to run to court like this.

with all the money he is making with 100's of appearances on CNN & MSNBC. And I am certain he is writing a book about Stormy case as well. That should be worth $25 Million or so.

A friend of mine had a show on MSNBC for a while. The average fee for a guest appearance is $250

When one considers the exposure on live camera to million of watchers. Wouldn't even cover hotel & food in a big city, never mind if air travel is also necessary.

...Stormy Daniel's and the truth. He never claimed to represent 'Democratic' interests, but I assume we're interested (as individuals and a party) in this president being held accountable for his words and actions.

I think Avenatti has excelled, so far, at representing these, to the benefit of anyone interested in confronting Trump.
