because the Senate was technically never in recess the last few years of Obama's presidency. SCOTUS said that Obama could make recess appointments when the Senate was officially in recess, but that the Senate decided when it was in recess, and McConnell never had an official recess.

and Republicans challenged his ability to do that. SCOTUS ruled that he could make recess appointments whenever the Senate was in recess, but that the Senate itself would decide when it was in recess. So, McTurtle decided to never let the Senate go into recess and ran proforma sessions so they would never meet the threshold of being in recess.

I believe Obama lost a few recess appointments with the SCOTUS decision as well.

I think Obama would have moved on it very quickly and appointed Garland. After all, Eisenhower made William Brennan a recess appointment to the Supreme Court only weeks before the 1956 election, and Brennan became a liberal icon on the court.

This is a new level of Democratic bashing on DU.

Normally it is reserved for something they can actually do.

As a reminder, recess appointments are done only during recesses. The Senate was never in recess.

Thus Obama could not do a recess appointment.

Doesn’t have a cult of deplorables who do his bidding, doesn’t have a cable news network that does his bidding, and doesn’t have a network of radio stations that do his bidding.


He’s fully able to make anyone who defies him the target of all of that, including Supreme Court justices. Is it physical violence? Not yet. But it doesn’t have to be to violent intimidate.

Wake up, and try and keep up.

even if Pence was the President. Their only concern (and the degree of it varies by Justice) is that the Court maintains or even strengthens its political position. That requires GOP control of the Senate and the Presidency.

and give TWITLER another seat on the Supreme Court. Him, the supposed "Swing Vote," who swings the wrong way more often than not. . As if TWITLER needs any encouragement to exercise vast powers. Wait'll he gets to fill KENNEDY's and probably GINSBERG's seats.

Remember when Bill CLINTON and OBAMA were labelled as LAME DUCKS who couldn't do anything because of Repuke obstruction, couldn't even get a nominee to have a hearing, much less a vote. TWITLER will be doing his TWITLER jig at any moment.

Besides KENNEDY's history, there's his recent history of hobnobbing with Ivanka and one or two of his sons having jobs in the TWITLER cartel.

People who voted third party or who are so lazy and entitled that they stayed home because they weren't "inspired" and their vote wasn't sufficiently "earned" are not Democratic voters.

Did they vote for Trump or one of the third party spoilers? Do they live in swing states?

You should counsel them to be careful not to play the useful idiot for propaganda peddlers the next time around and advise them to take responsibility and apologize for the damage they helped to cause. Your admonitions concerning delusions are better directed at them.

History will not easily absolve your friends. Nor should it.

..our need to be loved by the arbiters of civility in DC like David Brooks and his ilk is paying dividends.

Clearly voters wanted "bipartisan and sensible" solutions. Clearly they rewarded us for our years of being nice and taking the high road and reaching across the aisle.

Let's make sure we keep doing that when we are in power again.

vulnerable folks to bring us to where we are today, and as far as I am concerned their hands are full of blood, and while they will never suffer the consequences of their fraud because of their means, many of those they misled will never recover from it
