In this day and age with constant bombardment - I can't let rage take hold.
I'm not going to jump to the conclusion that he will never be charged, and if indeed he IS the perp, he gets his day in court.
That's all I can do.

(18,311 posts)The military will press charges and the state will drop theirs. The Navy can make his life much, much worse than the civilians can. Depending on how close he is to retirement the ultimate punishment is booted out under 20 years so retirement is forfeited.

(14,151 posts)Especially since he beat a civilian kid in front of civilian witnesses at a civilian event just because the kids were doing what kids do. It doesn't matter how serious a racist local sheriff or prosecutor thinks the matter is. And I'm pretty sure there was alcohol involved. The guy is not only a CPO - a supposed leader - but he's working with recruiters, in which there are always public optics to deal with.
The Navy can't bury this incident on base. He's got to go.
Article 128:
(a) Any person subject to this chapter who attempts or offers with unlawful force or violence to do bodily harm to another person, whether or not the attempt or offer is consummated, is guilty of assault and shall be punished as a court-martial may direct.
(b) Any person subject to this chapter who
(1) commits an assault with a dangerous weapon or other means or force likely to produce death or grievous bodily harm; or
(2) commits an assault and intentionally inflicts grievous bodily harm with or without a weapon;
is guilty of aggravated assault and shall be punished as a court-martial may direct.
At the very least, less than honorable discharge and no pension. No military health care, no VA benefits. And he has to start over in the civilian world with a bad discharge - he might as well have been charged with felony assault.

(29,860 posts)Because he's active duty. They don't want to get involved in a big case because the Navy will pick this up and run with it. The city/state will drop charges when the Navy picks up and the charges from the Navy will be severe.
I live in a military town. Local almost always gives a misdemeanor charge unless it's so severe it needs a huge bond or no bond. The military will pick up the charges so most prosecutors see no reason to file beyond the misdemeanor. It's just not worth their time.
BTW - assault against a child in public with civilian onlookers? He's done for.
