I agree there is nothing in the Constitution preventing indictment, subpoenas, etc. However, I think there are legitimate separation of powers concerns about whether the sitting President can be forced to personally participate in a legal proceeding. Note this is a different question than obtaining documents and tapes like with Nixon.

The specified process for removal is impeachment. We don't want Congress to be able to hassle a President with constant requirements to personally appear in court. Would you really want Devin Nunes to be able to force President Hillary Clinton to stop what she's doing and constantly have to appear in court, based on bizarro conspiracy theories?
