Ken Starr: Giuliani's Wrong, The President Can Be Indicted

Former independent counsel Ken Starr told Morning Joe on Wednesday he thinks a sitting president can be indicted.

“I think the president can be indicted,” said Starr, who led the investigation into former President Bill Clinton‘s sexual misconduct with Monica Lewinsky. “But that is not the position of the Justice Department traditionally.”

“The basic point is we do not have an authoritative resolution on the issue,” he said, noting it “cannot happen, as I see it, under Justice Department policy that’s enforceable on [Special Counsel] Bob Mueller.”

“No one is above the law,” he said. “And so in my judgment the president can in fact be indicted.”

MSNBC’s Joe Scarborough asked about whether a president can be subpoenaed, noting that Trump lawyer Rudy Giuliani once said that presidents are subject to subpoena, but now claims a president can defy a subpoena.

“Well I love Rudy, but Rudy was right then,” Starr replied. “The takeaway from [my] book is that Rudy is not correct now.”

“The president is subject to subpoena,” Starr said.

I was going to rewind and count how many times he said or referenced his book, but I was too disgusted to do it.

Who cares if he's promoting it? Everyone else who writes a book gets to promote it so as far as Starr is concerned, let him have at it.

The important take-away to me is that Starr is pointing out that Giuliani doesn't know what he's talking about. I love it when Republicans attack one another. Discord on the Right works in our favor.

Besides, on this point, Starr is probably correct and a president can be subpoenaed and indicted. The whole navel-gazing legal discussion is inside baseball. If the president has committed crimes, he'll be held to account one way or another. I predict that if Democrats retake the House and begin honest investigations of Trump and his administration, some Republicans will come around when it's time to vote on impeachment because the criminality well be so blatant.

More importantly, I'm not going to buy Starr's book and I'm confident you won't, either.

They pretty much all do it when they are on book tours.
I’m sure their agents and publishers remind them to mention book a lot.
