(9,527 posts)What the FBI would do is a background investigation which wouldn't be relevant after being confirmed. It's not a criminal investigation.

(52,126 posts)that said, you'd have to prove a felony beyond a reasonable doubt, which i would think would be a real challenge for something 34 years ago.

(52,126 posts)she can file a police report and ask the state of maryland to file criminal charges, but in practice i would think they are not likely to try a case from 34 years ago, lacking physical evidence.
more practically, she could sue in civil court for damages due to emotional distress and such.

(21,529 posts)But the time to deal with it is really now since it is much easier to not confirm than impeach. This is a lifetime appointment. A delay of after weeks or months wont hurt anything.

(1,058 posts)it's not a federal crime, but they can, I believe, investigate his lying to congress under oath, that is a federal crime.
