What the FBI would do is a background investigation which wouldn't be relevant after being confirmed. It's not a criminal investigation.

........which by my reading specifically states that there was penetration, but I see no citing that extends that to " (attempted) sexual assault". Can you give a citing for this?

that said, you'd have to prove a felony beyond a reasonable doubt, which i would think would be a real challenge for something 34 years ago.

she can file a police report and ask the state of maryland to file criminal charges, but in practice i would think they are not likely to try a case from 34 years ago, lacking physical evidence.

more practically, she could sue in civil court for damages due to emotional distress and such.

But the time to deal with it is really now since it is much easier to not confirm than impeach. This is a lifetime appointment. A delay of after weeks or months won’t hurt anything.

it's not a federal crime, but they can, I believe, investigate his lying to congress under oath, that is a federal crime.

They only get involved in the investigation of federal crimes. I really don't understand why this is such a difficult concept for so many people.
