(115,674 posts)Of the other conservative justices only Thomas is as far out in right field as this guy. I don't think even Gorsuch is as far off the rails; he's just a Scalia clone - and Scalia wasn't always crazy. Roberts and Alito are conservative but within the mainstream - and I have to think Roberts will be concerned about the legitimacy of the court with his name attached. There is definitely a danger that all five would overturn Roe v. Wade, either entirely or in part. I'll have to read it again to think about the angle they might use, but it will probably have to do with the right to privacy, which isn't specifically found in the Constitution, or states' rights. Although the originalists might hate the unspecified right to privacy, if that goes down so do Griswold v. Connecticut and Loving v. Virginia. States' rights would be the safer theory (for them).
I do think that only Kavanaugh and Thomas are far right enough and politically partisan enough to come up with a unitary executive theory that would completely protect Trump. I don't think Roberts would go for it. I hope I'm right.

Roberts will go along with Kavanaugh. I truly believe that.

(115,674 posts)He is known to be someone who prefers compromise. As the head administrator he also has power over who writes opinions and who should recuse themselves. I don't think he wants to go down in history as the guy who presided over a lawless, illegitimate, disrespected Supreme Court, and he has a fair amount of power to keep that from happening.

(53,410 posts)Extreme Right wing decisions are OK. He tends that way so someone like Kavanaugh so obviously pushing, not leaning, to the radical right will definitely impact the entire dinamic of the Supreme Court.
Today Weve seen a man who is emotionally supercharged to fight whatever his cause is. If youve ever dealt with such people you know how they take over in any situation.
