Assuming all the Dems (10) vote no, and the other Repubs (10) vote yes...only Flake hasn't made a decision.
If Flake votes yes, I think it goes to the rest of the Senators. If Flake votes w/the Dems, it's up in the air what they will do.
IMO, it's not a good sign that Flake is struggling so hard with this decision. In other words, I take it that he wants to vote no, but the pressure on him from his party is immense. He'll be hated & ostracized. He's leaving the Senate, but may pursue other political office, maybe. He may even be kicked off his committees.
Flake has caved before.

(8,708 posts)Even in the 0.000001% chance that Flake would vote against Kavanaugh, McConnell has said that he plans to bring up Kavanaugh for a vote before the full Senate regardless, from my understanding.

(37,648 posts)But Flake shouldn't be struggling so hard with the decision, unless he succumbing to pressure but still trying to fight it, to do the right thing. But he has voted yes before, when he said he was against something. Might have been the healthcare bill.

(13,346 posts)If Flake votes No he makes a name for himself. Republicans will still appoint the next SCOTUS nominee anyway. The new nominee will not be the albatross Kavanaugh is going to be for the Republican Party. If Flake wants to run against Trump, he'll be the frontrunner. He'll be the guy who got Republicans a better nominee than Kavanaugh, and he'll be the guy who voted principle. He'll be the anti-Trump in the GOP primary, and they'll be looking for one.
