A Late Night Observation

I just saw the clip of Lindsey Graham from earlier today, where he’s talking to reporters after the agreement to have the FBI do a further investigation of Kavanaugh.

He looked as though he’d just had the weight of the world taken off his shoulders. He was smiling from ear-to-ear – he was absolutely beaming, and was very collegial with the reporters. He acted as though the further investigation was a big win for him and his side of the aisle.

This is mere speculation on my part, but I’ve suspected for the past few days that despite their show of a united front, the PTB in the Republican party are finally realizing that Kavanaugh’s confirmation comes with too high a political price. They’re seeing the protests, they’re seeing a veritable ocean of angry women – voting women. They’ve heard the talk about complaints being filed against Kavanaugh, whether he’s confirmed or not.

They’ve heard the rumours that other accusers might come forward (aside from the three we know about) – and, if refused a voice in a formal setting, will take their stories directly to the media. And we all know how much 24/7 media attention they would get. They now know how many people were riveted to their TVs to watch the hearings yesterday and - despite the usual pundits claiming the opposite - they know how badly Kavanaugh's performance was.

And the timing of confirming Kavanaugh, in the wake of all of this, couldn’t be worse. Were the midterms a year away, many people who are pissed-off now would have cooled down, and might vote Republican based on other issues. But no one who is seething mad right now is going to cool off by the time they go to the polls in November.

I honestly think the GOP has been trying – especially after Kavanaugh’s and Ford’s testimony – to find an “out” with respect to Kavanaugh’s confirmation. And today that “out” presented itself. If the FBI investigation exposes anything untoward about Kavanaugh’s past, they can kick him to the curb and move on with another nominee whose confirmation won’t trigger the negativity towards their party they are dealing with now.

Elected Republican reps are being bombarded with phone calls, emails, letters, and protestors. They know which side of their bread is the buttered side, and it isn’t the side that ignores the voices of women voters – a demographic they’re already in trouble with.

Like I said, pure speculation on my part. But Graham’s reaction to the news that a re-opening of the FBI’s investigation into Kavanaugh was going ahead tells me that it was news that was not only welcome, but embraced the way a drowning man embraces a life preserver.

If Kavanaugh goes down, Graham has already done his screen test for the AG role, so he’s accomplished what he set out to do for his own career. What happens to Kavanaugh from here on in is in the hands of the FBI, which means the GOP could possibly be rid of the albatross around their party’s neck - and be rid of him at someone else's hands.

...everything Trump touches dies.

Men now in deeeep conversation with Mueller or in prison initially thought they could ride Trump's coattails to greater riches and power, having spent decades of their lives corruptly making money, associating with international gangsters, and in general flying just under the legal radar.

Jeff Sessions -- I have no idea what his personal corruption level was or is, but his life as AG has been an exercise in Hell and Humiliation.

Good luck Lindsay.

scenario? Lindsey Graham's behavior has been shocking to everyone, especially considering his dearly departed friend. Maybe he's playing the long game...for revenge against trump. Either that or he's gone senile.

Congressional Republicans wanted him out

Trump wanted him in.

In fact he was close to out so Trump got Graham to blow it up.

I will add another baseless idea. Roberts leaked to Congressional Republicans that Kavanaugh was not welcome on the court.

Roberts wants a professional center right court not a highly partisan court. With the legitimacy of both the Executive and Legislative branch being under siege it would be disastrous if the Supreme Court devolved into a daily partisan circus.

It was interesting that the court sent back the issue of naming contributors to PACs with an 8-0 vote.

All of our institutions, but especially the court which has no direct democratic participation only work because the idea is accepted, like the dollar bill for example.

I believe Roberts is more committed to the reputation of the court than any other single thing. Kavanaugh will be a disaster while another Gorsuch type will be fine.

I think he was thoroughly embarrassed by the turn of events. So he pulled his well known, comfortable, likable Senator Graham out of his ass for today's cameras.

He returned to his usual image - The smooth Senator and loyal friend of John McCaine we all know. The Graham who always has time to stop and drop a witty tidbit for the press to nibble on. He's thinking to himself, "The wonder of me." And in that moment he snatched Flakes courage and used it to turn his own failure into personal success.

Pay no attention to the Graham of yesterday. The one with the stainless steel teeth. The one whose soul was buried with McCaine*. Just pick a card, any card.

GOP (and their masters) have a week to gauge the whirlwind that is coming to reap them.

Let Kavanaugh ponder that one.

May it grow to a category 6 hurricane of votes that sweeps monsters out of governments at all levels.

I've never agree with the idea that they've all sold their souls but after the last few days I have to accept they have.

Flake has never been that impressive but at least he's had moments of showing a spine, his capitulation today was the final act of giving in by the GOP to all that is bad in the US. Forget about the women who confronted him, you could see he was pained to do vote yes and he kew he shouldn't yet somehow he gave in and did. The worst part is that he didn't need to, there was almost no political downside to voting no. He's not running again and even if he's running for President his no vote would be forgotten because Trump would have just nominated someone else and Flake would have voted yes then and they would still get their conservative on the court. You could see it in his face, he KNEW this was wrong, he KNEW what he witnessed yesterday should never have been uttered by a nominee for SCOTUS and yet somehow he gave in.

The women in the elevator were just the out he needed to do the bare minimum and demand an investigation and that got him off the hook for voting yes. No matter what the investigation finds (which will be nothing) he got him out of comittee and now it will be someone else's problem. Make no mistake they will push him through, they have shown there is nothing good left in any of them.

That it was his inner workings with tRump's circle that probably concluded that Kavanaugh was too toxic and that Alan's 1:21 AM tweet this morning (yeah, how old is he?) was a signal that an FBI investigation would allow tRump to save face, instead of having to withdraw his nomination himself.

It's not set in stone, but I feel there's a high probability that there's going to be some additional disqualifying information to come out of that investigation and BK will be gone.

We'll continue to keep the pressure on as if there's been no investigation, but this feels good.

He won't have to rant and rage for trump again. Now that the FBI investigation will take place he doesn't have to try to attack others now for wanting it. this will cost Graham all respect , and he'll be targeted for removal from office after all this, if he's not hauled off to prison first if he has ANY ties to putin , russian money , or campaign election violations and criminal activities that are uncovered , I'd be shocked if nothing is there, and he did nothing. His actions speak very differently now.
